Bengaluru bar fire: Authorities crack down on pubs, eateries over fire safety

The death of five employees in a bar-cum-restaurant blaze in Bengaluru on Monday stirred the civic body and police to crack down on all bars, pubs and eateries to ensure fire safety norms are followed, a top police official said."We have directed the BBMP and the police to inspect all bars, pubs, restaurants, hotels and eateries across the city to check for fire safety norms," Karnataka Director General for Fire and Emergency Services MN Reddi told reporters in Bengaluru. Reddi, who inspected the Kailash Bar and Restaurant where the fire broke out killing the five men trapped inside its compound and the Victoria Hospital, said prima facie the bar in the congested city centre had no fire extinguisher and did not follow the safety norms."The premises where the fire accident took place had no exit door, ventilation, exhaust fans or any escape route from behind," said Reddi, an IPS rank officer. Reddi, a former Bengaluru police chief, also said that preliminary inquiry revealed that the victims died due to asphyxia than severe burns as they suffocated to death due to lack of fresh air, ventilation and no exit point."The victims seem to have tried to escape from the dark premises but could not as they failed to break the iron grill windows. No fire precautionary measures were in place at the bar," said Reddi. Bars, pubs, restaurants and eateries across the city are required to follow safety norms by providing clearly marked exit doors in case of a fire along with firefighting equipment, said Karnataka Home Minister Ramalinga Reddy."The premises where the fire accident took place didn't even have a fire extinguisher. The police will be inspecting all bars, restaurants and eateries," he told reporters. The rules laid down by the civic body Bruhat Bengaluru Mahanagara Palike (BBMP) state that public buildings should be provided with exits to allow safe escape of occupants in case of fire along with installation of alarm devices to alert people and that the buildings must be equipped with fire extinguishers. After the deadly fire at a rooftop bar in Mumbai on December 29 claimed 14 lives, the BBMP has raided several bars, pubs, restaurants and eateries in Bengaluru. According to Excise Department data as of March 2017, Bengaluru has a registered total of 866 liquor shops, 1,375 bar-cum-restaurants, 74 pubs and 189 hotels and boarding houses selling liquor.  The city has 3,130 registered liquor-selling outlets, including all the liquor shops, restaurants, pubs and hotels as per the Excise Department. Last week, as many as 57 rooftop pubs and restaurants were served closure notices by the civic body for operating without required licenses. Karnataka State Fire and Emergency Services Department had also issued notices to nearly 70 bars, pubs and eateries in the city for flouting the fire safety rules. The establishments were given a 15-day notice to comply with the norms.

Karnataka woman driven to suicide, harassed for friendship with man from different community

In the suicide note we have found that a group of men had gone to the girl’s home in the evening, confirmed police.
A degree college student living in Chikkamagaluru committed suicide after a group of men harassed her for talking to a man from a different community. A BJP Yuva Morcha worker has been arrested on charges of abetting suicide. Dhanyashree (20) committed suicide around 10 pm on Sunday night.   Police officials in Mudigere recovered a suicide note at the home of the victim which alleges that a group of five men questioned her friendship with a person from another community.   “In the suicide note we have found that a group of men had gone to the girl’s home in the evening and got into a fight with the girl and the girl’s mother. They accused her of roaming with a person from another community thereby creating issues of love  jihad, ” said K Annamalai, Superintendent of Police, Chikkamagaluru.   Trouble started when Dhanyasree chatted with a friend of hers. The friend, Santosh, questioned her over her friendship and she replied saying 'I love Muslims'. A screenshot of this reply was widely circulated among groups in the district, especially Sangh Parivar groups.  The police have also identified a photograph of the woman with the man that was circulated on social media and are looking to question everyone who has passed comments about it.  “There was a photo in which the girl is with a boy from another community and a lot of people have circulated this photo creating aspersions on the girl so we are also trying to find whoever has sent the photo to this girl by making any comment which would have hurt her to take this extreme step,” said Annamalai.   We are getting deep into social media accounts to try to understand whether anybody from outside has given some kind of comments or a threat from outside,” said Annamalai.   “We have arrested one guy named Anil and we are searching for four others,” said Annamalai. “Any person who we think has played a part in this girl committing suicide, we will make sure that they face the law,” added Annamalai.  

Denied ration for not linking Aadhaar, Chikballapur Dalit families eat raw veggies in protest

16 Dalit families in Chowdadenahalli village have been denied ration for the past 1.5 years as they have not linked ration cards to Aadhaar.
Forty Dalit families spread out mats and took out mangoes, spinach and other raw vegetables on the outskirts of Chowdadenahalli village in Chikballapur. But instead of a picnic, the families are out to protest against the Food and Supplies Department after being denied ration for the past one-and-a-half years. The reason? Not linking ration cards to their Aadhaar. Families including women and children turned up on the outskirts of the village and are defiant that they will not go back to their homes until the Food and Supplies Department gives them their due ration. “We are here because 16 Dalit families in the village are not getting ration for the last one-and-a-half years. When we asked the Food and Supplies Department about this, they said that we have to link our Aadhaar cards to receive ration,” said Nagesh, one of the protestors. While the linking of ration card to Aadhaar was made mandatory in February 2017, to avail food grains from the Public Distribution System, the Centre in October instructed states to not deny Public Distribution System benefits to those who do not have Aadhaar or have not linked their ration cards to Aadhaar. The protesters said that they had raised the issue with Karnataka Food and Supplies Minister UT Khader. But they also added that even though he assured that Aadhaar should not be a reason to deny ration and promised to look into the issue, he is yet to do it. They spread out mats half-a-kilometre away from Chowdadenahalli village and are eating leafy vegetables and mangoes to satisfy their hunger. “We are eating spinach leaves and other raw vegetables. We want the Food and Supplies Minister to hear our voice and resolve this issue,” said Shashiraj, an activist from Chintamani in Kolar. The testimonies of the villagers in Chikballapur is the latest among a number of cases of ration being denied to those who have not linked their Aadhaar cards. In October, over 20 people from various districts of Karnataka shared their stories of struggle and helplessness after they were denied ration for failing to link Aadhaar at a public hearing organised by The Right to Food campaign in Bengaluru.   

Manual scavenging deaths: Is the police protecting residents of posh Bengaluru apartment?

Over 36 hours since the incident, the police have not made any arrests in the case. Their excuse: The contractor – also a manual scavenger – died in the incident.
Until Sunday afternoon, Mahadeva Gowda was the sole breadwinner of his family. But on Sunday, life changed for his wife and two young daughters, as the 42-year-old suffocated to death inside a manhole in a posh Bengaluru residential society.  Mahadeva was cleaning a manhole in the ND Sepal Apartments in Somasundara Palya in HSR Layout, along with 52-year-old Srinivas, and 35-year-old Narayana Swamy – who was also the contractor for the job. On Sunday evening, all three men were asphyxiated inside the toxic sewer, and while Narayana and Srinivas died inside the manhole, Mahadeva died on the way to the hospital. Over 36 hours since the incident, the police have not made any arrests in the case: The contractor, Narayana Swamy, was also a manual scavenger who died on the job, and therefore the obvious ‘villain’ the police could pick up is gone. But what about the residents of the apartment who got workers to go into a manhole, against all existing laws and humanity – not even with some protective gear? "We have to see whether the residents gave consent to this," says Ramesh Kumar, Inspector of the Bandepalya Police Station in HSR Layout. “We are exploring whether the residents can be charged. The investigation is on and we will know more soon," he adds. The police say they have registered an FIR under IPC sections 304A (causing death by negligence) and 34 (Acts done by several persons in furtherance of common intention), against the apartment association instead of any individual. But the police have refused to share the FIR with either the media or activists. Lawyer and activist Narasimha Murthy says this is one of the ways in which the police help the banned practice of manual scavenging to continue.  “In these cases, the authorities are hand-in glove with the perpetrators.The police is not giving any clear picture. They have registered an FIR but are not sharing any details. violating the Supreme Court guidelines,” he says. “Moreover the case is filed under section 304A – which is a non cognisable and bailable offence. The actual section is 304 part II, which reads as culpable homicide not amounting to murder,” he adds.  Another activist-lawyer, Maithreyi Krishnan says, “They have to take action against the apartment dwellers. This is just an informal contract, the contractor is not officially registered. The STP lies inside the apartment complex, they are responsible. The FIR should be against the contractor, apartment owners, and the BWSSB engineer.” “The principal or the only role of the BWSSB is sewage treatment. Sewage treatment wherever in the city is their responsibility. They can't say that STPs have come up and we have no responsibility at all. That is their statutory, obligatory function,” she says. Manual scavenging is a banned practice in India, but it continues to be practiced across the country; activists say lack of enforcement is what encourages this practice to flourish.  According to official figures, 68 people persons died in the last 12 years due to manual scavenging in Karnataka alone. Àmong these, 13 deaths were in greater Bengaluru in the last two years. Following the incident on Sunday, Bengaluru Development Minister KJ George announced an ex-gratia compensation of Rs 5 lakh to the next of kin to all the victims. But the families of the victims are in too much shock to process any of this. Nagaraj, the brother-in-law of Mahadeva Gowda, says the family didn’t even know he was cleaning sewers. "BBMP has promised Rs 5 lakh for us, but we don't know what we will do. We are in a state of shock. He would go and do pest control in other buildings and I do not know how he ended up like this.”

‘If I want to eat beef, I will’: Siddaramaiah slams UP CM Yogi over cow politics

In the ongoing war of words between Karnataka CM Siddaramaiah and UP CM Yogi Adityanath, who was recently in Bengaluru for a BJP political rally, the CM from the southern state has hit back at the priest-turned-politician who asked him to prove his Hindu credentials. “A lot of Hindus eat beef. If I want to eat, I will, who are they to tell me not to consume beef. I don’t eat beef only because I don’t like to. He should read what Swami Vivekananda said about cow slaughter before preaching us,” Siddaramaiah said, according to TOI. Siddaramaiah also questioned Yogi’s own credentials in tending to the cow before attacking him, and tweeted “Has Yogi Adityanath, who is preaching us about conservation of cows, ever grazed cows? I have reared cows, grazed them and cleaned dung. He does not have any moral authority to speak on the issue.” Siddaramaiah was responding to Yogi, who had said in his rally earlier, “When we were in power in Karnataka, we had enacted a law prohibiting cow slaughter. The Congress government as soon as it came to power, repealed that law. The cow is a very scared animal to Hindus. If Siddaramaiah is a Hindu and talks of Hindutva, he shouldn’t allow cow slaughter.” KPCC Working President Dinesh Gundu Rao however took a softer stand and tweeted, “Siddaramaiah or the Congress has never promoted beef-eating. Our Constitution and our laws allow people to eat food of their choice. Stop dividing India on religion, caste, diet, culture, practice and dress code.” Yogi Adityanath was in Bengaluru campaigning for the BJP ahead of the state assembly elections in Karnataka and participated in the Parivartana Yatra which started on November 2. “In the past five years, the Congress has pushed Karnataka backwards. Karnataka needs to benefit from the development programmes of Prime Minister (Narendra) Modi. The youth, farmers and cities like Bengaluru need these programmes, and for this Karnataka needs a BJP government,’’ he had said.

K’taka hospital declared accident victim dead while he was still alive, alleges family

However, doctors at the Karnataka Institute of Medical Sciences have denied any wrongdoing.
In a case of alleged medical negligence, friends and family members of a Hubbali youth have accused doctors at the Karnataka Institute of Medical Sciences of declaring him dead, while he was still alive.  23-year-old Praveen Mulle was brought to the hospital with grievous injuries due to a road accident and was declared “dead" by doctors.  His friend and co-passenger Anil Renuke was also brought dead according to doctors at KIMS. Praveen was driving a Ritz hatchback and four of his friends were in the car at that time. They were brought to the hospital after the car turned turtle on the outskirts of Hubbali. However, doctors at KIMS have denied any wrongdoing. Both the bodies were shifted to the hospital mortuary but Praveen's family alleged that when they came to receive the body, his heart was still beating and he was still breathing. After this, they claim that he was taken to a private hospital where doctors said he could have been treated if he was brought earlier. Soon, protests erupted demanding punishment for the "negligent" doctors and compensation for Praveen's family.  Speaking to TNM, KIMS Director Dr. Dattatreya Bant said that what the private doctors are saying is not right. "The truth will come out once a post-mortem is done. He was brought dead and he was shifted to the mortuary. When the attendees went to take the body, the family claimed they found the patient’s heartbeat was there,” he told TNM. Later, addressing reporters, acting Medical Superintendent of the hospital said, “There was a lot of commotion after relatives of one of the persons claimed that the person was alive. They took the body to a private hospital called Life Line without our permission. There, the senior doctors concerned said that rigor mortis has set in and the person may have died 3-4 hours ago or earlier. The body was then brought back.” “Even after they were declared dead, both the bodies were kept in the casualty ward for half an hour. They were shifted to the mortuary only after checking the necessary parameters,” he added.

The police on Tuesday arrested 8 members of ND Sepal Apartment Association, in Somasandra Palya, Tuesday in connection with the death of three men while cleaning a manhole in the apartment complex. “We have arrested 8 people from the apartment in connection with the incident for negligence. The contractor, who was also negligent in this case, died along with two others. The contractor was trying to clean the motor when the incident happened,” said Ramesh Kumar, Inspector at Bandepalya Police Station. All 8 men arrested work as techies and businessmen in the city. The contractor Narayana Swamy (35), Mahadeva Gowda (42) and Srinivas (52) died after they entered a manhole inside the premises of ND Sepal Apartments in Somasundara Palya in HSR Layout in a bid to manually clean. Mahadeva Gowda passed away while being taken to Columbia Asia Hospital, while the bodies of Narayana Swamy and Srinivas were recovered by fire and emergency personnel from inside the manhole. An FIR was registered at the Bandepalya Police Station under section 304A (causing death by negligence), read with section 34 (acts done by several persons in furtherance of common intention) of the Indian Penal Code. Initially, police officials were unsure of who they should be taking action against. "We have to see whether the residents gave consent to this and are exploring whether they can be charged. The investigation is on and we will know more soon," Ramesh Kumar had earlier said. But pressure from human rights activists and lawyers following the incident appears to have forced the police’s hand. Employing a manual scavenger has been made a cognisable offence with imprisonment and fine since 1993, and the Prohibition of Employment as Manual Scavengers and their Rehabilitation Act 2013 and a Supreme Court ruling state the same. But the banned practice continues to flourish across the country as the ban has not been enforced properly by the government or private parties.

Come February 1, Bengaluru traffic cops to get tough on helmet rule

Putting safety first, the Bengaluru police will now penalise motorists not wearing helmets which comply with ISI certification or comply with standards of the Bureau of Indian Standards. However, commuters will be punished only from February 1 and in the meanwhile the Traffic Department is trying to educate users about the importance of proper helmets. “A sudden enforcement may create panic and inconvenience among motorists. Hence, we have decided to create awareness about the issue. After a month, there will be a strict enforcement of the rule against using non-ISI certified helmets,” Additional Commissioner of Police, Traffic, R Hitendra told The Hindu. The official Twitter handles of the Bangalore Traffic Police departments have also been tweeting about the importance of helmets. A United Nations study says that a proper helmet can improve chances of accident survival of by 42% and helps avoid 69% of injuries to riders. Incidentally, the city police initiatives come after Karnataka Home Minister Ramalinga Reddy praised the Mysuru police for launching a drive against half helmets or sub-standard helmets. The Home Department had also passed a directive to ensure the same recently. Not only Bengaluru and Mysuru,  Karnataka police chief Neelamani N Raju has directed the state police to ban non-conforming helmets in the state, reports The Times of India. All the five police commissioners —Bengaluru, Mysuru, Mangaluru, Hubballi-Dharawad and Belagavi and range IGPs have also been communicated the same, the report said. Statistics of the Bengaluru Traffic Department show that offences related to wearing helmet has only risen over the three years. In 2015, the number of riders fined for not wearing helmets were 1.77 crore. The same number gradually increased to 1.88 cr in 2016 and more than 2 cr in 2017 respectively. Until, 2016 pillion riders were not required to wear helmets by law.   But here, the situation has improved since 2016. The number of such violations decreased in 2017 by 5 lakh even though the ban came in force much after the year started in 2016. Safety expert MN Sreehari welcomed the move. "It is not just a rule, it has to be followed. Youngsters have a habit of not wearing helmet. They should not only wear helmet to appease policemen but should do it on their own for their safety and the helmet should completely cover the user's ears and have ISI mark," he said.   

Meet Shilpa Reddy, B’luru corporator who uses social media to solve people’s issues

This first-time corporator and her husband have deployed WhatsApp effectively to address the needs of the people in her Ward.
Imagine a politician calling you up and asking whether you have any civic problems that have to be resolved. What if you get regular WhatsApp messages from your neta to check if the streetlight across your road is shining and not on the blink, or whether the garbage van has reported on time? How would you feel if your complaints get a response instantly and are solved within a day or two, times out of 10 times? This is no work of fiction or any ‘Thalaiva thriller’ that solves tomorrow’s problems yesterday and today’s concerns before they are even born. This is reality in Ward No 58, New Thippasandara (Hosathippasandra), in Bengaluru city, where a digital revolution has been on for a while, propelled by the Ward’s commander-in-chief Shilpa Reddy (32), a first-time corporator associated with the Indian National Congress. Her weapon – WhatsApp. Her target – your needs. Her Man Friday – her husband Abhilash Reddy. Elected in 2015, Shilpa defeated the sitting Bharatiya Janata Party (BJP) corporator Sumitra Vijayakumar by 1,698 votes. Incidentally, she had lost to Sumitra in 2010 by 820 votes. Falling under the CV Raman Nagar Assembly constituency, Ward No 58 has around 36,000 voters. The main localities of the ward include Michael Palya, HAL III Stage, Seethappa Colony, Venkateshwara Colony, Puttappa Colony, Bhumireddy Colony, Annayappa Colony, LIC Colony, Bairasandra, Krishnappa Garden, KG Colony, Garkamanta Palya, Binnamangala, BM Kaval, 515 Colony, Patel Seethappa Colony and New Tippasandra. Lessons from her first loss Shilpa, a mother of two, says she was upset when she learnt of her loss in 2010, but the lessons she learnt from it were enough to make her battle-ready for the 2015 elections to the Bruhat Bengaluru Mahanagara Palike (BBMP) or Corporation. “The loss made me focus on Ward No 58 more keenly and, along with my husband and his friends, we planned the strategies silently. In the next five years, we mapped all the problems and needs of the Ward. We kept the plans ready and in 2015 my manifesto spoke only about the core issues of the Ward. No big announcements,” says Shilpa. After her 2015 victory, her husband Abhilash became the face of the Ward. “The very first day after the election results were declared, we were out to clear garbage that had piled up in the area. The idea was to stop people from dumping garbage in open places. This was such a menace here. I would pack dinner for Abhilash and his friends, and they would sit in vehicles and keep a watch through late nights, to prevent people from dumping garbage on roads in different areas. This went on for over a month and we managed to give a facelift to many areas. Garbage collection is now door-to-door,” smiles Shilpa. BBMP stakeholders part of WhatsApp groups There are around 10 active WhatsApp groups for the Ward, and what makes them a hit is that people’s queries get an immediate response. Abhilash has identified his trusted lieutenants to handle the issues, and he monitors them on an hourly basis. “We added all the officials concerned to various groups. The stakeholders coming in made all the difference. So engineers of Bangalore Electricity Supply Company (BESCOM) and Bangalore Water Supply and Sewerage Board (BWSSB) are all part of our groups. We have added the traffic police as well. To address the problems of people instantly, especially those of senior citizens, is our top priority,” says Abhilash. He credits the success of his missions to a team of his friends and well-wishers who are willing to roll up their sleeves and get down to work if the situation warrants it. Abhilash unclogs the drains in a flooded road. “I have done odd jobs before entering politics. I have no hang-ups about clearing the garbage or unclogging drains if the road is flooded. Politics is becoming a 24x7 job. With the help of technology you can do wonders,” says Abhilash. ‘Governance at our doorstep’ This correspondent chose residents at random from various WhatsApp groups of Ward 58 to hear their views. Surprisingly, there were no negative comments at all.  “We have suddenly seen the politics of accountability. We have interacted with the BBMP in the past as well. But, for the first time ever, we are experiencing speed in the resolution of issues,” says Jayashree Ganesan, a retired banker. NS Mani, a retired engineer, says the corporator’s WhatsApp movement is much better than the groups of many RWAs (Resident Welfare Associations). “It sometimes surprises me that all our calls are answered. Also, the corporator is very people-friendly. We have never had this kind of an experience. We are lucky to have such a corporator,” says Mani. “While Shilpa handles the administrative part of being a corporator, Abhilash is the man on the ground. When we post a concern often it gets a response instantly. This is a great revolution,” says Meenakshi Prabhu, a homemaker. Ananth Ram, a cable TV operator in the area, has been helping the couple address people’s problems. His regular interactions with his cable customers (around 5,000) have come in handy for the corporator, to get feedback from the ground. “I am acting as a bridge between the people and the corporator. It is my way of doing social service. The WhatsApp groups are getting popular by the day as people post even the smallest issue here,” says Ananth. NK Narayanan Nair, a retired employee of a private firm, residing in Krishnappa Garden, gives an example of the efficiency of this power couple. Never in the past had the BBMP asphalted one of the two roads leading to his house. “We called the corporator’s team and brought to their notice the neglect of the road and drains in our locality. A solution came within couple of weeks. We still can’t believe that the drains were desilted and the road blacktopped by the BBMP in no time,” says Narayanan, whose son is a fighter pilot with the Indian Air Force. ‘Shilpa’s people-connect model inspiring’ The All India Congress Committee (AICC) Secretary PC Vishnunath, in charge of the Mysuru division of the Congress, overseeing various activities ahead of the 2018 Assembly elections in Karnataka, says the innovate people-connect model adopted by Shilpa and her team in Ward No 58 is inspiring. “I am really happy to know how the residents have benefitted from this digital drive. I am sure the senior citizens are the most satisfied lot. There’s a renewed push in the Congress to use technology and social media to reach the masses. The story of Ward No 58 will become a model to others,” Vishnunath told this correspondent. Incidentally, the AICC General Secretary and Karnataka in-charge KC Venugopal had in October last year pulled up many party leaders for not using social media to their advantage as is being done by their BJP counterparts. Karnataka Home Minister Ramalinga Reddy says that the use of technology is the way forward to address the needs of the people. “I am aware of the work being done by Shilpa and Abhilash. I am keen to know how they are able to get results at a faster pace by forming WhatsApp groups for localities. Even we have digital groups in my constituency, but it is inspiring to see a first-time corporator making such an impact. I am impressed,” says Ramalinga, who is a six-time legislator. The couple oversee the work done in Ward No 58. Of the seven corporators in the constituency, three are from BJP, two from INC and two are Independents. Supporters of Shilpa Reddy say that the sitting three-time BJP MLA from CV Raman Nagar constituency S Raghu is showing a ‘stepmotherly treatment’ towards the needs of Ward No 58. They accuse the MLA of not releasing funds for the Ward for the last two years. But, Raghu, a seasoned politician, smiles at all these allegations and says that his work speaks for itself. “Anyone serving people and doing good work will have to be appreciated. I am aware of the WhatsApp groups that are active, and we too have similar initiatives. See the number of parks I have developed. We have a new drinking water plant. A government school has been sanctioned. Welfare measures have been implemented without a break and that’s why I have the people’s mandate,” says Raghu, who is among the early birds to have begun working towards the 2018 polls. He maintains that he treats all corporators equally, and allegations and counter-allegations are only part of the game. “I am happy that the people are benefiting from the use of technology and social media campaigns. At the end of the day, it is the people who will call the shots, and not politicians,” adds Raghu. Social media ushers revolution Senior journalist and political observer Dr M Gautham Machaiah says social media has brought power to the fingertips of the people – especially the youth, who swear by technology, and senior citizens, who, with ample time on their hands, can raise the red flag even from the confines of their homes through their mobile phones. “Ultimately, in India, elections are fought and won largely on caste, money and other considerations, but candidates who deploy social media to address civic issues will have an edge over others in the days to come. An injunction against 32 print, television and electronic news outlets was taken out by Bharatiya Janata Party leader and former Deputy Chief Minister of Karnataka R Ashoka for ‘false and defamatory’ reporting on his involvement in the Bagair Hukum land scam. The list of media outlets includes the Times of India, The Hindu, Udayavani and Vijayavani, and also news channels like ETV News, Udaya News and Public TV. The injunction comes on the same day the Anti-Corruption Bureau registered an FIR against Ashoka and others in connection with the Bagair Hukum case. It prohibits media outlets from reporting derogatory or false news relating to ‘alleged illegal acts done during his tenure as the President of Bagair Hukum Regularisation Committee in the print and electronic media’. The court order restrains media outlets from ‘making any sarcastic, defamatory remarks and using any indecent and unparliamentary remarks and opinions against the plaintiff in the news or broadcast’. “The injunction is about the Bagair Hukum case. The case was quashed by the High Court years ago and they are reopening it now. R Ashoka has taken an injunction prohibiting media channels from reporting on the case,” said Prakash, a BJP spokesperson. Bagair Hukum cultivators are farmers with no formal ownership rights to the government land they have occupied over the years. Lakhs of Bagair Hukum cultivators had applied seeking title deeds. On November 2 last year, Congress workers demanded the recovery of 2,500 acres of land denotified and allotted to various beneficiaries in 75 villages of Bengaluru South Taluk by BJP leader R Ashoka when he was the Deputy Chief Minister and Chairman of Bagar Hukum Regularisation Committee. They claimed that there were irregularities in the allotment of land titles to Bagair Hukum cultivators. The alleged irregularities took place between 1998 and 2006 when Ashoka headed the committee.

Five days after Shankaramma gave birth to her daughter, the hospital discharged her and told her to not ask questions and go home without the child.
For over a year now, 35-year-old Shankaramma from Karnataka’s Bagalakote district has been running from pillar to post to bring her baby back home. On 9 November, 2016, she gave birth to a baby girl, but five days later, Kathari Nursing Home and Multispecialty Hospital, in Bagalakote’s Ilkal, allegedly refused to hand over the child and told her to go home. According to Shankaramma, when she asked them where her baby was, they refused to tell her. Ever since then, she has tried every possible course to bring the child back home. On Monday, the Dharwad bench of the Karnataka High Court ordered a Central Bureau of Investigation probe into the case of the missing baby. “My baby girl was so beautiful. She was the prettiest baby I’ve ever seen. I was in the ICU after the delivery for five days and, on the sixth day, they shifted me to the general ward. I’ve only ever held my baby five times. I had even thought of naming her Pratiksha. My husband and I had decided to hold a function for her as well. After the fifth day, the hospital staff never let me touch my baby. When they were discharging me, I asked them where my baby is. They just told me to shut up and go home. They did not tell me what happened to my little girl,” Shankaramma told TNM. As soon as she was discharged from hospital, Shankaramma approached the Hungunda Police Station to register a complaint. “The police there refused to register an FIR. The hospital had snatched my baby from me and even the police were not willing to take up the issue. I felt so helpless at the time. I went back to the hospital and begged them to give me my baby. The hospital staff took away my reports and told me that they will tell the police that I never went to the hospital for child birth in the first place,” Shankaramma said. But this did not deter Shankaramma. Every day, for two months, she visited the hospital and begged the staff to return her baby. “They told me that my baby was dead. When I asked them to show me her body, they just told me to leave. They kept changing their story. Once they said she was dead, then they said she was not dead and that she has been sent to another hospital for treatment. They just refused to show me my baby. They put me through a lot of mental torture,” Shankaramma said. In February 2017, Shankaramma, along with representatives of the Dalit Sangharshana Samiti, visited the Bagalakote Superintendent of Police Ryshyanth and submitted a copy of the complaint. “That was when the SP ordered the jurisdictional police to register an FIR. But instead of registering a missing person’s complaint and one against the hospital, the Hungunda Police registered an FIR for criminal intimidation. There was nothing mentioned about the hospital or the missing baby in it. Shankaramma sells lemons for a living, she is not literate and the police have taken advantage of her. She did not realise that they had registered a wrong FIR,” said Havargi, Shankaramma’s lawyer. It was only in July 2017 that Shankaramma realized what sections the FIR was registered under. Enraged, she decided to take up the matter with the Karnataka High Court. On July 25, 2017, Shankaramma filed a habeas corpus petition with the Dharwad bench of the Karnataka High Court stating that her baby had been missing since November 2016 and that the police had not helped locate the child. The High Court had ordered the Additional Superintendent of Police to conduct a probe into the matter. On Monday, the court reprimanded the ASP and ordered a CBI probe into the matter. The hospital and the police refused to comment on the matter. “I hope someone takes up my problem seriously. I have not seen my baby for over a year. I only held my baby a handful of times. I have never got to watch her grow. I just want my baby back. I hope the CBI conducts a proper investigation,” said Shankaramma.

Speaking at a press conference at Congress Bhavan in Bengaluru, Parameshwara said, "Rahul Gandhi went to a temple in Gujarat and they (BJP) are calling it an offence. Have Congress leaders not gone to temples in the past? Didn't Indira Gandhi, Rajeev Gandhi, Nehru and Shastry not go to the temple? Weren't they Hindu? If Rahul Gandhi goes to temple, they are saying Congress is playing soft Hindutva. Ours is not soft Hindutva, it is an inclusive Hindutva." He defended the ruling Congress government’s regime in Karnataka. “However, I know that the people of Karnataka are mature enough to judge the performance of Congress government during the last five years. This current government has delivered on almost all the pre-poll promises made in the 2013 election manifesto. What is even more remarkable is that these have been fulfilled without a single corruption scandal, unlike the five-year BJP rule from 2008 to 2013 that saw three chief ministers, imposition of President’s Rule, and ministers quitting office on corruption and rape charges,” he said. Karnataka is set to go to polls with the state assembly elections in May and the Congress and the BJP have both taken out rallies to canvass for votes.

The right wing vigilantes in Dakshina Kannada are keeping busy, and their latest targets are two student leaders – a Muslim man and a Hindu woman. The vigilantes are circulating WhatsApp messages of the two young people, ‘warning’ the man – Hamza Kinya – against ‘roaming around on bike with our Hindu girls in broad daylight.’ But this time, the vigilantes have bitten off more than they can chew. On Tuesday, the 20-year-old woman – Madhuri Bolar – filed a complaint at the cyber crime cell of Mangaluru city police. For days, the picture of Madhuri Bolar along with her friends – one of them a Muslim – has been making rounds on certain WhatsApp groups. The picture was accompanied by a message in Kannada: “Hanma Kinya is roaming around on bike with our Hindu girls in broad daylight… If he is further seen roaming around with Hindu girls, Hindu organisations must reply to him (act on him.)” Message and photos circulated in right wing WhatsApp groups. According to Madhuri, both the image and message were out of context, and it came to her as a rude shock. "The selfie was taken almost a year ago, when all of us were travelling in a bus to a camp. It was uploaded by one of my friends. However, the rumour mongers did not mention that; neither did they mention that along with Hamza and me, there were Suhas Adiga and Ganesh Bolar as well in the photo," Madhuri, who is also the District Secretary of Student Federation of India (SFI) said. Madhuri further added that as Hamza was the Joint Secretary of district SFI, he was required to travel to such camps with other office bearers including herself."Since their (vigilante groups’) other tactics and smear campaign have failed to have their effect on us, they are now trying to bring us down morally by levelling such baseless allegations," she said. Not to be bogged-down by her harassers, Madhuri along with her mother Bharati Bolar, filed a complaint at the Mangaluru Police Commissionerate. In her complaint, Madhuri has identified at least six-WhatsApp groups and their users, and has named two men and one woman, who were  allegedly spreading misinformation and causing her psychological trauma. Speaking to TNM, Madhuri's mother Bharati Bolar said that, as it is, teenagers in Dakshina Kannada are constantly harassed by religious vigilante groups. "On Sunday, a young girl at Mudigere even committed suicide after she was harassed by vigilantes for talking to men outside her religion. This should stop. I will support my daughter in her complaint and have insisted that the police act against the perpetrators," Bharati said. A member of the CPI (M)-affiliated Beedi workers' organisation, Bharati also said that parents must stand by their children if they are victims of such harassment. Police Commissioner TR Suresh, who heard the mother and daughter duo, forwarded the complaint to the city’s cyber crime branch. It is learnt that the case has been registered at Pandeshwara Police station limits. In Dakshina Kannada, that is still reeling from the brutal murders of Deepak Rao and Abdul Basheer by communal elements, the religious vigilantes have stepped up their 'policing' efforts. Last week, a minor girl was targeted at the district administration run Pilikula Nisargadhama, after she was spotted in a picnic group that included a boy from another religion. Elections are less than six months away in Karnataka and it is not only the BJP and Congress that are locking horns with each other in the poll-bound state. The  Mangaluru City North unit of the BJP led by its president Y Bharath Shetty has sued former CM and Janata Dal (Secular) state chief HD Kumaraswamy for Rs 1 crore for allegedly defaming the party. The case was filed in connection with Kumaraswamy’s statement on the recent murder of Deepak Rao, a Suratkal-based BJP member.  Kumaraswamy had said on Tuesday, “I have information that BJP leaders are behind the killing of Deepak Rao. Why is the Congress government silent on this?” "Are BJP and Congress working together? I do not know what the state government is doing and whom it is trying to protect?” the JD(S) state chief had added.  Speaking on the defamation suit filed by the party, Bharath Shetty said, “Kumaraswamy, who does not know anything about the situation here, gives a statement sitting in Mysuru. His statements not only confuse people but also mislead the investigation.” “We have taken it seriously and filed a case in the Mangaluru court. Vikas Puttur and Ashok (party office bearers) are witnesses in the case. All related documents have been submitted to the court,” he added. Kumaraswamy made this statement after Congress MLA Mohiuddin Bava said that one of the accused in the case, Pinky Navaz, was a member of the BJP’s minority wing. The Janata Dal (Secular), led by its state chief and former CM HD Kumaraswamy, according to most political observers is the third horse in the race for power. But with its strong base in the old Mysuru/Cauvery delta region, the party might be a kingmaker for either of the national parties if they are short of the magic number of 113 seats. A member of the BJP’s IT cell in Dakshin Kannada, Deepak Rao, was waylaid and murdered allegedly by four Muslim men on January 3. In suspected retaliation for his murder, a Muslim man named Basheer was attacked within hours of Deepak’s murder. Basheer succumbed to his injuries after battling for his life for four days in a Mangaluru hospital. The coastal Karnataka region is infamous for repeated incidents of communal attacks which regularly claim lives of activists on both sides.

Twenty two Dalit families in Chowdadenahalli village in Chikballapur district have received one-and-a-half years worth of ration and PDS cards after they protested by eating raw vegetables on the outskirts of the village on Monday. The protesters opposed the denial of ration for failing to link their ration card to Aadhaar card. After TNM reported about the incident, the authorities incharge swung into action and ensured that they got their supplies immediately. “We all got 1.5 years worth ration, and PDS cards from the government. The Tehsildar is also meeting us today to clarify the issues we had in getting ration,” said Nagesh, a resident of Chowdadenahalli who was protesting the denial of ration.   The action was taken after officials read about the issue on TNM, and the district authorities decided to resolve the issues immediately. They claimed that Food and Supplies Minister UT Khader had been informed of the discrepancies in receiving ration and that they had provided their contact details including their addresses to the minister. As the protesters did not receive a reply, they decided to protest against the issue by spreading out mats and eating raw, uncooked food including leafy vegetables and mangoes on Monday The testimonies of the villagers from Chikballapur is the latest among a number of cases of ration being denied to those who have not linked their Aadhaar cards. In October, over 20 people from various districts of Karnataka shared their stories of struggle and helplessness after they were denied ration for failing to link Aadhaar at a public hearing organised by The Right to Food campaign in Bengaluru.

In November, fact-checking website Alt News called out Malviya for sharing pictures of Jawaharlal Nehru embracing his sister and niece. Malviya had tweeted a collage of pictures showing Nehru with various women. His words accompanying the collage said: "It seems Hardik has more of Nehru's DNA, contrary to what @shaktisinhgohil claimed." He was believed to be referencing a tape reportedly showing Hardik Patel having sex that went viral. MM Kalburgi’s wife demands SIT probe into his murder: SC seeks Centre’s response

Kalburgi was killed on August 30, 2015 in Dharwad and Uma Devi has alleged that the probe by the Karnataka Police had not made any headway.
The Supreme Court on Wednesday sought a response from the Centre on a plea by Uma Devi, the widow of rationalist MM Kalburgi, seeking a SIT probe into his murder. Chief Justice Dipak Misra, Justice AM Khanwilkar and Justice DY Chandrachud sought the response as Uma Devi demanded a coordinated probe in the killings of Kalburgi, Govind Pansare and Narendra Dobhalkar as the circumstances surrounding them were the same. Kalburgi was killed on August 30, 2015 in Dharwad in Karnataka and Uma Devi has alleged that the probe by the Karnataka Police had not made any headway. Uma Devi said the SIT must be headed by a retired judge of the apex court or a High Court. The notice has also been issued to the Central Bureau of Investigation, the National Investigation Agency and the Karnataka, Maharashtra and Goa governments. Speaking at the time of the incident, Dharwad City Police Commissioner Ravindra Prasad had said that two people had arrived at the 77-year-old writer’s Kalyan Nagar residence on a motorcycle in the morning. “They knocked on the door and shot him when he opened the door.”  Roopadarshi, Kalburgi's youngest daughter, who was in the house when Kalburgi was shot, said that the writer had not faced threats prior to the murder.  But the writer, known for his critical writings was threatened by Hindu militants in 1989, for writing a Kannada book they claim blasphemes a 12th century saint. He was given 24-hour protection by police in Dharwad and a group of 43 Kannada writers and academics formed a committee in support of the book. Meanwhile, in 2007, fellow Kannada writers criticized him for his views on the state anthem naada geete. He had reportedly said: “We have not been able to find a good nada geethe. Some people are of the view that incorporating the names of rivers, saints, religions and writers will make a nada geethe. Is it not possible to produce a better and intense nada geethe?” Currently, the state anthem is Jai Bharata Jananiya Tanujathe, which was composed by one of the finest Kannada writers Kuvempu. Although Kalburgi had not taken any names, a debate had been generated among writers. Groups such as the VHP, ABVP, Bajrang Dal had filed cases against him and also demanded his arrest for allegedly offending religious sentiments during his speeches. On one occasion, groups of people belonging to these organizations even threw stones and soda bottles at him. Police provided protection to him until Kalburgi himself requested them to withdraw it. Residents in K’taka may have to start shelling out more money on cabs now

A new notification states that cabs will be divided into 4 categories based on their size and the minimum rate has been fixed accordingly.
Residents of Bengaluru may now have to shell out a minimum fare of Rs 44 for small cabs and Rs 80 for bigger sedans. According to a notification issued by the State Transport Department on Wednesday, the government is fixing the minimum fares of cabs based on the type of car. Until now cab aggregators like Ola and Uber were free to charge what they wanted, but with this notification, the prices of taxis may shoot up drastically. Under the new scheme, radio taxis, as per the Karnataka on-demand Transportation Technology Aggregators rules, will be able to charge fares based on the amount they have paid to buy the vehicle. The notification has divided cars into four categories of taxis –the most expensive has been classified as Category A and the least expensive car categorized as D. “The minimum fare for the first 4 km for every class of taxi will be fixed. This may be between Rs 44 for a D-category vehicles and Rs 80 for A-category vehicles,” HM Revanna, the Transport Minister said. The notification says that the waiting period for cabs will be free for the first 20 minutes after which a charge of Rs 10 will be levied for every 15 minutes of time spent waiting. “This has been a long-standing demand of drivers who have been complaining about pricing issues, which has led to them earning very low incomes,” Revanna added. The Minister also said that the cab-aggregating companies had not yet responded to the price-change model. According to the notification, a D-category taxi, costing up to Rs 5 lakh, will have a minimum fare of Rs 44 for the first 4 km, after they can charge anywhere between Rs 11 and Rs 22 a kilometre. A C-category vehicle, costing between Rs 5-10 lakh, will have a minimum fare of Rs 52 for the first 4 km, after which the maximum price per kilometre can be between Rs 12 and Rs 24. For a B-category vehicle, costing between Rs 10-16 lakh, the maximum fare for the first 4 km is Rs 68, after which the maximum price can be Rs 34 and a minimum price can be Rs 16 per km. Similarly, for an A-category vehicle, costing more than Rs 16 lakh, the maximum fare for the first 4 km is Rs 80, after which a maximum amount of Rs 45 or a minimum of Rs 20 per km can be charged. Reacting to the new norms, Tanveer Pasha, President of the Karnataka Taxi Drivers Association, called the move an “election gimmick”. Speaking to TNM, Pasha said, “The new norms are unscientific. They will not benefit the drivers of normal taxis, nor will the customers benefit from it. This has been done purely to appease Ola and Uber companies and help increase their revenue. It is an election gimmick. This will help only drivers of Ola and Uber but not anyone else,” Pasha added.

Ever waited for several minutes at a busy Bengaluru road, waiting to cross? Ever spent a lot of time fruitlessly hoping that the vehicles zipping by would take pity on pedestrians? Well, the Bengaluru traffic police have come up with a solution that, they believe, will be the end of all our woes. They’re all set to install 60 Pelican (Pedestrian Light Control Activation) traffic signals in the city – which will allow you to press a button, activate a red signal, and cross the road easily. Except, when we tried one such signal at St Mark’s Road, the results weren’t so welcoming. Watch what happened: After two attempts, the person finally managed to reach the other side of the road, as cars and bikes didn’t quite care for the red light. But not before one car almost ran over another pedestrian trying to cross the road when he had the right-of-way. The recently installed equipment has also been damaged on one end by miscreants.  The system is quite popular in Western countries, and the concept is not new to Bengaluru either. In 2005, 52 Pelican traffic signals were installed in the city, and today, only a few are functional. A majority of these signals were in a dilapidated state by 2010, according to then Additional Commissioner of Police (Traffic) MA Saleem. The few signalling systems that are still functional, exist mostly in the Central Business District. Pedestrians complain that vehicles do not stop even after seeing the red light. But this time around, the announcement has been received warmly by citizen activists in the city. “This is a positive sign and we welcome it. Sixty is not enough, we probably need another 600 of these in the city. For the last few years, pedestrians have been made to take the skywalk. But this is good, this reiterates the sense that everybody has equal right to the roads. This also makes pedestrians feel safe and gives them the required dignity,” Srinivas Alavilli, founding member of Citizens for Bengaluru told TNM. “If you ask anybody in Bengaluru how they walk on a road, they would say, “I keep my heart in my hand and make a dash.” I am not even talking about senior citizens and people with disabilities. They are being put through some sort of house arrest. There is a perception that the road only belongs to cars, that is not true,” he added. Citizens for Bengaluru will also organise public events to create more awareness on this. “We do not want skywalks in the city except at places like Outer and Inner Ring Road,” Srinivas added. Work on installing these signals will begin in 10 days’ time and is set to be completed within two months, Additional Commissioner of Police, Traffic, R Hithendra, told TNM. “Wherever in the city, pedestrian deaths are taking place or places where we have identified that pedestrians are facing difficulty, we will install these signals. Places with schools and colleges nearby will be given priority,” the senior officer said. However, a formal list is yet to be prepared. “We have to check if there is power supply and other factors,” he said. “Signal jumping is a common problem, even in normal traffic lights, if there are no policemen, people tend to cross the signal. We are trying to book cases. This is the only thing that can be done. The drivers should also be made aware with respect to the rights of those who walk on the road,” Hithendra added.

Save Kukkarahalli Lake: Mysuru collective opposes constructions on lake bed

The collective has also opposed infra development around the lake to encourage tourism.
The Kukkarahalli Lake Ulisi Samiti has launched a campaign to stop a Regional Science Center being built on the lake’s catchment area in Mysuru. The Samiti, a collective of citizens in Mysuru who serve as a watchdog of the lake, keeps an eye out for developmental activities in and around the lake. Members of the collective regularly visit the lake to ensure that no new constructions come up. The foundation stone for the Regional Science Center was laid in 2015, but due to the efforts of various NGOs in Mysuru, the construction was halted. About a year ago, the collective came together, while the government began developmental works to improve the lake’s facilities with the idea of enhancing tourism. “We have grown with the lake from the days of our engineering education in Mysuru, when we started visiting the lake. It is home to many birds. We came together a year ago to oppose the initial developmental activities. They (government) wanted to give importance to tourism, but we firmly opposed the idea,” said Guruprasad, part of the Kukkarahalli Lake Ulisi Samithi. The initial works involved desilting of the lake which was also opposed by the Samiti. “Desilting is usually beneficial to lakes, but the officials were preparing to desilt the shoreline where many birds breed, which was among a number of reasons why we opposed it. It was not the season for desilting either,” said Guruprasad. The lake has been officially declared as an Important Bird Area (IN197) by Birdlife International, a global collective of conservation organisations. The collective also claimed that the lake was frequented not only by migratory birds but also reptiles and mammals. This included the Golden Jackal, and birds like Eurasian Thick-nee, Spot-billed Pelican, Oriental Darter and Oriental White Ibis which have all been documented in a bird atlas of the lake. The collective also pointed out that the construction of a Regional Science Center in the lake’s catchment area will lead to an increased footfall and therefore increase in waste around the lake. “We are not opposed to the Regional Science Center, we welcome it, but we are opposed to it being built on the lake’s catchment area,” said Guruprasad.
