With only memories of a glorious past, Kolar voters eye polls with disinterest

There are a total of 16,12,227 electors in the entire Kolar constituency. As per the 2011 census, the scheduled caste population in Kolar district is 30.3% of the total population – highest in the state. Hence, Kolar is one of the five parliamentary constituencies reserved for Scheduled Castes in Karnataka. As per the Karnataka Chief Electoral Officer’s website, Kolar Gold Fields (K.G.F) is the smallest assembly constituency under the Kolar parliamentary constituency with 1,90,239 electors, of which 2,399 are voters aged between 18 and 19. Once known as ‘Little England’, KGF now wears the deserted look of a ghost town. Last week, as I drove into KGF, a big hoarding announcing the polling date of April 18 hoisted next to the cyanide salt dumps – a significant reminder of the glorious mining past – welcomed me. As I passed the Oorgaum station, I noticed the large number of parked two wheelers; many working class people commute daily to Bengaluru city for work. Ever since the nationalised mining company BGML (Bharat Gold Mines Limited) closed all the mines in 2001, jobs have been hard to come by in the town. BEML, the other major employer, has also slowed down operations and has not been recruiting for many years. Thanks to the British who brought in many workers from the then Madras Presidency to work in the mines, KGF boasts of a largely Tamil speaking population. Rusting mining equipment peep from behind the shut gates of the many mines as a stark metaphor for the miseries of the miners who are yet to receive 50% of their promised VRS package. The BGML workers unions have not given up and due to their continued efforts, the final verdict of the Supreme Court in 2013 was in their favour, approving the proposal to float a global tender. But the government is yet to implement the judgement, forcing the union representatives to take the matter to the court again. I was told that the next hearing is scheduled in three months’ time. The candidates The union representatives I met sounded very positive about the future. But what about political support, I asked. Since it is election time, are they putting any pressure on the candidates? The response wasn’t enthusiastic. Although KH Muniyappa, the sitting Member of Parliament from Kolar (he was elected to the Lok Sabha for the seventh time in 2014), has worked closely with the members of the 18 BGML unions in the past, he seems to be backing the Karnataka state’s plan to utilise the 12,000 odd acres of real estate and has raised the request in the 16th Lok Sabha to hand over the land to the state government. This hasn’t gone down well with the BGML employee unions (at least the ones I spoke to). While the ex-employees are still hopeful of a profitable closure, the rest of the town, including the politicians, seem to have moved on from the mining story. It is hardly an election issue. The vendors in the old market of Robertsonpet seem to think that there is no option but to vote for Muniyappa. On the surface, it is the truth. While the Congress and JD(S) were pitted against each other in a closely fought election in 2014, this time both the parties are fighting as a coalition and the BJP’s candidate S Muniswamy, a corporator from Bengaluru, is unknown in the constituency. One vendor says Muniyappa has the money power to create a last-minute swing. A lady disagrees, proclaiming that the Modi wave will sweep Kolar too. This was the first time since morning that I heard someone mention Prime Minister Modi. At lunch, I tried to talk to the manager of the 60-year-old Hotel Janardhan, but he seems least interested in the elections. Several others too express the same lack of excitement about the elections. They probably don’t think a change in their fortunes is around the corner. The people in this town seem as desolate as the place. Stuck in a time warp As one ex-miner put it, when nothing much has happened in 28 years of loyally supporting one candidate, what can happen now? He also reminisced of a time gone by, while flashing his Communist party membership card, when the workers’ movement was better organised and leaders such as CM Arumugham, Comrade Suryanarayana Rao and others were active. He and many others like him seem to be stuck in a time warp, while their children have embraced the new capitalist order, and have left the town to become software engineers, finance professionals, and such. The many Ambedkar statues spread over the town hint of a political past ruled by Dalit leaders and trade unions such as CITU. The Republican Party of India (RPI), a party with roots in the Scheduled Castes Federation (SCF), is still active and won the Assembly election as recently as 2008. Driving past the erstwhile mining offices, the old colonial houses (now occupied by ex-miners), playgrounds, schools, bakeries, churches, clubs and hospitals, I got the sense that time had stopped in KGF since 1956 – the year John Taylor & Sons handed over the operations to the state of Mysore and left for England. Poll issues Apart from employment, water and housing seem to be the other main issues across the Kolar constituency. One pet peeve seems to be that despite being so close to Bengaluru, the district hasn’t developed as much as it could have. I also visited the KGF water works, located a few kilometres away in Bethamangala and built in 1904. The facility is still up and running, but the receding water levels in the tank are alarming and need urgent attention. A lot will depend on the monsoon this year. The facility, although initially set up to supply water only to KGF mines and residents, now supplies to Bethamangala and BEML too. Again, the filtration system and the technology seem unchanged since 1904. Out of the eight assembly constituencies in Kolar, Mulbagal, KGF and Bangarapet are reserved for Scheduled Castes. In the 2014 elections, while Muniyappa bagged the maximum votes in Srinivasapur, Mulbagal, Kolar and Malur, the runner-up Kolar Kesava of the JD(S) won in Sidlaghatta and Chintamani by a high margin, and EM Narayanswamy of the BJP emerged triumphant in KGF and Bangarapet. The soft-spoken but shrewd ex-union minister for state, Muniyappa, has been expressing confidence of his chances this time too, despite a number of disagreements with some Congress leaders. There have also been reports of the JD(S) not providing support to his candidature. Muniyappa’s margin of victory in 2014 was a decent 47,850 votes. The BJP has turned a new leaf in its approach to the Kolar constituency by ignoring Dalit leaders like Narayanaswamy, DS Veeraiah and placing confidence in the Kadugodi (a Bengaluru suburb) corporator S Muniswamy. Will the fatigue of the miners fighting for justice, the anti-incumbency factor, Modi wave, and BJP’s fresh face defeat Muniyappa’s claim to the seat for the eighth consecutive time? In Shirthadi, a village in the forested area of Moodbidri in Dakshina Kannada district of Karnataka, the residents of the village patiently wait for the arrival of Congress candidate Mithun Rai for a roadshow. Mithun, 27, is the surprise young candidate picked by the Congress party in its bid to end the continued dominance of the BJP in the coastal district. He is popular in and around Moodbidri and in the southern parts of Mangaluru, and has launched an aggressive campaign to wrest the Dakshina Kannada seat away from the BJP, which has won the last seven Lok Sabha elections held in the district. The saffron party has fielded two-time MP Nalin Kumar Kateel and Mithun is hoping to capitalise on the BJP leader’s perceived misgivings - the failure of completing developmental works including Pumpwell and Thokottu flyovers, and the development of National Highway 169 running from Mangaluru to Bengaluru. He has not raised a single question regarding development, employment, communal harmony, social justice and about the overall development of the district. The works on Pumpwell, Thokottu flyovers and National Highway 169 are yet to be completed. We should ask him what is completed.” The Congress has also criticised Nalin and the BJP for failing to prevent the merger of Vijaya Bank, a bank built by a group of farmers in Mangaluru in 1931. It was merged with the Bank of Baroda on April 1, a day that Congress workers and leaders in the district marked as a ‘Black Day’. Campaigning in Puthige, around 15 km away from Shirthadi, Nalin appears to be calm in the face of the stinging criticism levelled by the Congress. “It is common in politics that when development is done, there will be criticism and this is all politically motivated. The reason for delay in Pumpwell flyover is partly due to the state government as well. There are other reasons but when there are elections, the opposition parties will use it to their advantage. The decision to merge Vijaya Bank was taken under UPA rule and we are hopeful of saving the name,” he says speaking to TNM. The decision to merge Vijaya Bank was taken under the leadership of Finance Minister Chidambaram during the UPA's rule however the merger went through only on April 1. The Congress is now pointing towards the profitable nature of the bank as the reason to stop the merger. Nalin Kumar Kateel campaigning in Puthige, Dakshina Kannada Nalin, an experienced campaigner, also reiterates that the people of the district will once again vote in favour of the ‘Modi model’ of development. “The development of national highway, port, airport, jetty for fishermen, coast guard training center, a plastic park, coconut park have been taken up in my tenure. The developmental works are still starting and when they are completed, the people of this district can clearly see the work done. For this, we need another five years,” adds Nalin. Many residents in the district however have grown impatient with the slow progress of developmental works. “The construction works of the jetty have taken years to complete and have been marked by delays by both the central and state governments. To improve the economy of Mangaluru, more facilities should be made for the fishermen community,” says Nandakishore HK, a boatmaker from Mangaluru. Answering the cycle of communal violence Mithun further chose to focus on the topic of communal unrest in Mangaluru. “Ours is a secular party. We follow all religions which means I worship my Hindu religion and respect other religions. This is the motto everyone should follow,” he says. Mithun Rai campaigning in Shirthadi In contrast, Nalin, who has spoken about the murders of BJP workers in Parliament, points out that communal violence has reduced ever since the district largely voted for BJP MLAs in the 2018 Karnataka Assembly elections. Nalin raised the issue of political murders in Karnataka in a January 2018 Parliament session, days after Deepak Rao, a BJP volunteer, was murdered in the district allegedly by four Muslim men. “There were Congress MLAs in Dakshina Kannada district in the last five years and in this time, there were murders of Hindus, Muslims and Christians. But in the last year, 7 BJP MLAs were elected here and there have been no violent incidents that are communal in nature,” Nalin says before adding, “We have also made a request to establish a branch of the National Investigative Agency in Mangaluru to ensure the safety of people.” Nalin Kumar Kateel poses with his supporters According to data compiled by activist Suresh Bhat Bakarabail of the Karnataka Komu Sauharda Vedike (Karnataka Forum for Communal Harmony), there were 741 communal incidents in Dakshina Kannada from 2013 to 2018 including 228 incidents in 2015. The numbers however have reduced to 108 since the start of 2018. “The number of incidents have reduced since the state elections last year and both the BJP and the Congress are claiming that it is due to their efforts,” explains Suresh, who has compiled data on communal incidents in Dakshina Kannada and Udupi dating back to 2010. The number of incidents usually spike in the time of elections but that has not been the case this time around. Suresh and other residents of the district remain hopeful that this election will be free of violence, and that the focus stays on the candidates and their vision for the district. Acute water scarcity in Karnataka: Tankers supplying drinking water in 26 districts

Another summer is here and Karnataka has been hit by a water crisis yet again. Starting from the capital city of Bengaluru to the traditionally arid northwestern part of Hyderabad-Karnataka region, the water crisis is alarming throughout the entire state. According to the State Emergency Operation Centre, a total of 996 villages in 26 districts are being supplied drinking water through tankers as a relief measure.  This is in addition to 815 villages which are getting drinking water supply from 1000 private bore wells hired by district authorities.     Among the worst hit districts are Tumakuru, Vijayapura, Chitradurga and Chikkaballapura having more than 100 villages. While Tumakuru is the worst hit with 142 villages serviced by these tankers, Chitradurga and Vijayapura have 112 villages each. Bengaluru Urban district has 18 villages while Bengaluru Rural has another 82 villages needing this emergency service. Even here, Tumakauru is the worst affected with 46 wards along with Kolar having the same number of affected wards. Bengaluru Urban is among the worst hit with 25 wards receiving water through tankers. while Bijapur has 10 wards and Koppal 13 wards.  And the situation is unlikely to change for the better as the monsoon which is set to arrive in June is also expected to be below normal. The state of Karnataka has already suffered three successive drought years. For the entire 2018, while 21 taluks got excess rainfall across the state, 73 taluks had deficient rainfall and two taluks had scanty rainfall. The rest 80 taluks had normal rainfall. Karnataka State Disaster Monitoring Centre’s Managing Director Srinivas Reddy said, “As far as places which are serviced by the Irrigation Department or urban local bodies are concerned, for now there is no such shortage as we have water in our reservoirs. But the remaining 60% of the state is dependent mostly on groundwater and they are facing problems. So even for Bengaluru, the problem is mainly in the newly added 110 villages which do not have Cauvery water supply. ” “In places where there is a crisis, the Revenue Department is making arrangements to ensure supply of drinking water through tankers using funds kept for state disaster relief,” he added.  As of Tuesday, the water levels of the state reservoirs are much below their full capacities, and nearly at the same level as that of last year. Tanks managed by the minor irrigation department are also running short of water. A majority of the districts have more than 50% dry tanks.

A badly managed audio launch ‘moment’ has turned JD(S) Mandya candidate Nikhil Kumaraswamy into a running gag ahead of the General Elections.
In 2016, Nikhil Kumaraswamy made his debut in the Kannada film industry with the film Jaguar. During the audio launch of the film, his father and current Chief Minister HD Kumaraswamy was on stage – and the father and son were part of a PR stunt that is, well, embarrassing to watch to say the least. “Nikhil yellu kanthane illa, yellidyappa? Nikhil, yellidyappa?” Kumaraswamy asks. (“Nikhil I can’t see you anywhere, where are you? Nikhil, where are you?”). And in a badly staged and poorly timed reply, Nikhil says from among the audience, “Ille idhini, Appa. Nimmanna, nam thathanna pranakkintha hechagi preethiso janagal madhya idhini, Appa.” (“I’m here, father. I’m with the people who love you and grandpa more than their lives.”) You can watch the clip from 3:42:52 in the above video. Unfortunately for Nikhil, the embarrassing moment from three years ago has come back to haunt him as he makes another debut – this time, in politics. The JD(S)’s Mandya candidate is the running gag in Karnataka this election season, with critics and everyday trolls alike jumping on the ‘Nikhil Yellidyappa?’ joke. Someone seems to have had some fun adding ‘Nikhil Yellidyappa’ as a location on Google Maps. One Twitter user tweeted what looks like a screen recording of the ‘location’. The location doesn’t exist on maps right now, however. The videos and memes have also caught the eye of filmmakers who are lining up to register films by the name 'Nikhil Yellidyappa'.  Karnataka Film Chamber of Commerce (KFCC) however is holding off on accepting the applications until the elections are over. “This is mostly from not-so-well-known filmmakers looking to cash in on the craze created around the phrase. We are not accepting any requests currently. Later the title committee will take a call if they want to give permission for a film with this title," Harish, KFCC secretary told The New Indian Express. The trend comes in the midst of a high-voltage campaign by Nikhil in the Mandya constituency against actor Sumalatha Ambareesh. He has also set up a social media team in Mandya to counter the negative publicity on Facebook and WhatsApp.

Sumalatha Ambareesh, the independent candidate from Mandya, alleged that JD(S) leaders in Mandya were also trying to lure her close associates.
Sumalatha Ambareesh, the independent candidate from the Mandya Lok Sabha constituency on Tuesday accused a top JD(S) leader of morphing her images and trying to intimidate her.  Speaking to TNM at Srirangapattana’s Kalenahalli, Sumalatha alleged, “I don’t know if I should speak about it now but a top JD(S) leader contacted me. He told me that he would morph my photographs to make them look like illicit pictures. He said he could morph my pictures to make it look like anything he wished to and that he was ready to do it. I would not be surprised if you see morphed pictures and videos of me in the future.”   Sumalatha also stated that she would not be hindered by such threats and that she would face whatever came her way. “I have not done anything wrong so I have nothing to fear,” she added.   Sumalatha Ambareesh is the wife of former Congress MP and legendary actor Ambareesh. She is contesting as an independent and is up against Nikhil Kumaraswamy, son of Karnataka Chief Minister HD Kumaraswamy and the JD(S)-Congress candidate from Mandya.   She also accused the JD(S) leaders in Mandya of trying to lure her close associates into the party and alleged that two of her aides, who work for her social media team were offered bribes by the JD(S) leaders.   “The leaders have contacted two people on my social media team and offered them money to make defamatory statements about me. In addition, the JD(S) leaders offered them Rs 15 lakh. They are also being pressured to go to Dubai until the dust settles. These are the ways the JD(S) leaders are targeting me,” she alleged.   Sumalatha also claimed that the family members of her associates informed her about the JD(S) leaders holding talks with them and said that they were under a lot of pressure.   Reacting to Sumalatha’s statement, Mandya district in-charge Minister CS Puttaraju said that the JD(S) has not reached such a pathetic condition that its leaders would morph Sumalatha’s pictures to gain votes.   “We are not in a pathetic condition that we have to resort to such tactics. If Sumalatha has not done anything wrong then why is she so scared? I don’t know why she is so depressed. The people of Mandya will make their decision clear on April 18 and we will win,” Puttaraju added.

Bye-polls to Karnataka’s Kundgol Assembly seat to be held on May 19

Bye-polls in Kundgol was necessitated following the demise of Minister for Municipal Administration CS Shivalli last month.

The Election Commission of India on Tuesday announced that bye-elections will be held to Kundgol Assembly constituency in Dharward district of north Karnataka on May 19.  Results for the same will be declared on May 23, along with the Lok Sabha Elections. Bye-polls will also be held in four seats in Tamil Nadu and one seat in Goa, announced the EC. May 19 is also the date of polling for the last and seventh phase of Lok Saba 2019 polls across the country. According to the Election Commission, the date of notification for the seats going to bye-polls on May 19 will be April 22. The last date of nominations will be April 29, while the scrutiny of nominations will be carried out on April 30. Candidates can withdraw from participation latest on May 2. Bye-polls in Kundgol was necessitated due to the demise of Minister for Municipal Administration CS Shivalli last month. On March 22, the minister passed away in a private hospital in Hubbali after he had suffered a cardiac attack earlier in the day. Shivalli, a veteran Congressman was a three-time MLA from Kundgol Assembly constituency and was a key aide to former Chief Minister Siddaramaiah. In the 2018 Assembly Elections, Shivalli had won from the seat with a razor-thin margin against BJP’s Chikkanagoudra Siddanagoud Ishwaragoud. He had in 2013 won comfortably against the same opponent. Shivalli was inducted into the cabinet in the second round of appointment of ministers after a mini-rebellion in the Congress in December 2018. Legislators from North Karnataka had alleged that they were not being represented enough. He was also reportedly approached by the BJP to jump ship. Lok Sabha Elections in Karnataka will be held in two phases. Polling will be held on April 18 in Udupi-Chikkamagaluru, Hassan, Dakshina Kannada, Chitradurga, Tumakuru, Mandya, Mysuru-Kodagu, Chamarajanagara, Bengaluru Central, Bengaluru North, Bengaluru Rural, Bengaluru South, Chikkaballapura and Kolar The remaining constituencies of Chikkodi, Belagavi, Bagalkote, Bijapur, Gulbarga, Raichur, Bidar, Koppal, Ballari, Haveri, Dharwad, Uttara Kannada, Davangere and Shivamogga will vote on April 23.

Sumalatha Ambareesh is contesting as an independent candidate while the BJP has decided to not name a candidate and back her in Mandya.
Prime Minister Narendra Modi on Tuesday backed multi-lingual south Indian actress Sumalatha Ambareesh, an Independent in the high-profile Mandya Lok Sabha constituency whom the BJP is supporting to wrest the seat from the JD-S."Sumalatha supported her husband and Kannada film star Ambareesh in promoting the native language and its culture for years. I express gratitude to Ambareesh and Sumalatha for their contribution to Kannada," said Modi in his 35-minute speech in Hindi at a Bharatiya Janata Party (BJP) public rally in Maharaja College grounds in Mysuru. Campaigning for the party's candidates in the old Mysore region, which goes to polls in the second phase on April 18, Modi fondly recalled the rebel star (Ambareesh), who died in Bengaluru on November 24, 2018 at the age of 66. Though Ambareesh won from the Mandya three times, twice as Congress member and once as Janata Dal-Secular (JD-S) member, and was a Cabinet Minister in the Siddaramaiah-led Congress government (2013-16), the ruling ally could not give Sumalatha its ticket to contest, as it has been a JD-S bastion since 2009 general elections. The JD-S has fielded Nikhil K. -- son of state Chief Minister H.D. Kumaraswamy and grandson of party supremo H.D. Deve Gowda -- this time. To support 55-year-old Sumalatha, the BJP has not fielded its candidate against her and decided to campaign for her in the high-voltage battle against 29-year-old Nikhil, an upcoming Kannada film star from Bengaluru. A section of the Kannada film industry is also supporting Sumalatha, and its superstars Darshan and Yash are actively campaigning for her as a gratitude to their hero and guru Ambareesh. Though the ruling Congress-JD-S alliance partners entered into a pre-poll seat-sharing tie-up to contest in all the 28 Lok Sabha seats across the southern state in the ratio of 21-7, its district leaders and cadres have refused to campaign for JD-S candidates in Mandya, as most of them are also ardent fans of Ambareesh, a native of Mandya and their demigod.

No sale of liquor in Bengaluru from April 16 to 18 during polls

The sale of liquor has also been suspended for the full day on May 23 due to counting of votes.
It is time to plan election weekend in the pub capital of Bengaluru after it was confirmed that the city will go dry for two days starting from 6pm on April 16 to 6pm on April 18 on account of the Lok Sabha elections.  Bengaluru is set to vote in three constituencies - Bengaluru (Central), Bengaluru (South), Bengaluru (North) on April 18. The sale of liquor has also been suspended for two days starting from April 16 to April 18 and for the full day on May 23, due to counting of votes."A 5-km radius of no-sale-of-liquor zone will be enforced if the adjoining areas do not go for voting and this will also extend to the other state if the borders come within a 5-km radius,” said Sanjeev Kumar, Chief Election Commissioner speaking to Deccan Herald.  Bars in the city are gearing up for high sales of alcohol in the coming week and are wary of alcohol being used to lure voters.  Establishments selling liquor have already come under the scrutiny of police and excise department ahead of the elections.  As per a report by The New Indian Express, the Excise Department has raided more than 4,000 establishments in Bengaluru since March 10 and has registered 18 cases, which is higher than the number of cases registered in January and February combined.

A techie from Chennai who had opened a company in Bengaluru was allegedly abducted by his former employees four times in the past one month for failing to pay them their salaries. A resident of Cambridge Layout, 23-year-old Sujay SK and had recently opened a new business in the city. The company shut down after a month of its opening and Sujay has allegedly not paid salaries to their employees. According to the Halasur Police, the techie’s father has filed a complaint with the police alleging that eight of Sujay’s former employees abducted him thrice between March 21 and 26 after Sujay was not able to disburse their salaries since January 2019. Police believe that Sujay was allegedly abducted for the fourth time on Monday as he has been missing since then. Sujay, along with a few friends, had started the private company, FGL Infotech near Electronic City in January 2019. Sujay had completed his diploma in engineering and had come to Bengaluru from Chennai with hopes of setting up a business. Sanjay, Niranjan, Rakesh, Tanzeem, Darshan, Rashmi, Likith and Vishwa joined FLG Infotech as employees in January this year. However, the firm shut down within a month due to management issues. Police told TNM that the eight employees began asking for their salaries but Sujay had remained elusive and had not returned their calls. Hence, the employees allegedly planned to abduct him. According to the police, on March 21, Sujay was allegedly contacted by Likith and Vishwa. The duo allegedly asked him to meet them at a bank near Halasur. When Sujay arrived, they allegedly forced him into Darshan’s car and took him to a secluded area and assaulted him with an iron rod. Sujay was dropped back home on March 23. Police said that Tanzeem and Sanjay allegedly abducted him once again on March 25 while Sujay was on his way to Tamil Nadu. Once again, he was allegedly beaten up with an iron rod. When Sujay told the duo that he was going to Tamil Nadu to bring back money, his abductors allegedly let him go. However, when the former employees realised that Sujay had not left for Tamil Nadu, they allegedly abducted him once again and took him to a farmhouse near Maddur in Mandya. “They tied his hands and legs and beat him up. He was later let go the same day near Mysuru Road,” the police added. Unable to bear the trauma of being abducted and assaulted, Sujay allegedly consumed a lot of sleeping pills on the night of March 26, police said. He was taken to the hospital by his father. However, once Sujay was discharged on Monday, he was abducted again and has been missing since. The police are trying to track him and the other employees down. Sujay’s father Shivam C, a former member of the armed forces, filed a complaint with the Halasur police after he could not contact Sujay. “We took his (father’s) statement and arrested Sanjay, Niranjan and Rakesh. We are tracking down the five others. We believe the same people abducted him,” the police added. The three have allegedly confessed to the abductions. The Halasur Police have registered an FIR under sections 363 (abduction), 324 (voluntarily causing hurt by dangerous weapon), 323 (voluntarily causing hurt), 339 (wrongful restraint) and 34 (common intention) of the IPC.

The Karnataka government on Tuesday transferred the Mandya Deputy Commissioner N Manjushree, who was also the District Election Officer, on the Election Commission's direction."On the EC directive, Commissioner of Public Instruction PC Jaffer has been posted as Deputy Commissioner and returning officer of Mandya with immediate effect," said an official statement issued by the State Election . The poll panel's direction came after the Bharatiya Janata Party filed a complaint against Manjushree for allegedly favouring JD(S) candidate Nikhil K, son of Chief Minister HD Kumaraswamy, and being biased against his Independent rival, multilingual actress Sumalatha Ambareesh, whom the BJP is supporting. The decision was made after Chief Electoral Officer Sanjeev Kumar went to Mandya to probe the allegations. Sumalatha and her aides had alleged that the DC did not act on their complaint over alleged errors in nomination papers submitted by Nkhil Kumaraswamy.  Polling in Mandya and 13 other seats will be held on April 18 in the first phase of the Lok Sabha election in Karnataka. Earlier in a similar move, the  Election Commission had shunted out Hassan Deputy Commissioner Akram Pasha following a complaint from Hassan legislator Preetham Gowda (BJP) who accused him of working in a partisan manner. Akram was accused of favouring Prajwal Revanna. Instead IAS officer Priyanka Mary Francis was posted as Hassan's new Deputy Commissioner.

The Income Tax Department accused CM Kumaraswamy and other ministers of making “false statements” and preventing government officials from discharging their duties.
Nearly two weeks after Chief Minister HD Kumaraswamy and other Karnataka ministers went on protest over Income Tax raids, it has come to light that the I-T Department has requested the Election Commission to pursue criminal proceedings against the CM and others. A letter dated April 5 written by Principal Chief Commissioner of Income Tax, Karnataka and Goa Region BR Balakrishna to the Chief Electoral Officer Sanjeev Kumar to this effect has come to light.  The I-T Department has asked EC to approach Karnataka Police Chief, the Director General and Inspector General of Police Neelamani Raju over the matter. The letter stated, “When persons occupying high public offices, including constitutional posts, make false statements and voluntary instigate, and involve themselves in, such criminal activities with the sole purpose of adversely affecting the processes of the law and preventing government officials from discharging their duties, such activities and statements criminally intimidate and harm the personnel of the Department with greater intensity .” It added, “It is in this background that the present complaint is being filed, with a request to take appropriate against the persons named hereinabove for the commission of various cognizable and other criminal offences.” Chief Minister HD Kumaraswamy, Deputy CM G Parameshwara, former CM Siddarmaiah and Water Resources Minister DK Shivakumar along others had held a protest outside the I-T Department’s office on Queen’s Road office in Bengaluru on March 28. The protests were against the alleged selective probe by the I-T officials against leaders of the Congress-JD(S) alliance at the behest of the BJP at Centre. A day before the raids were carried out, the CM had alleged that he was expecting I-T searches to be carried out with the intention of helping the BJP. Besides the protest, the I-T Department has also objected to the statements given by the leaders of the coalition against the raids. The letter stated that the I-T Department had conducted a search on contractors and engineers involved in government contracts, and in the districts of Hassan, Mandya and Mysuru officials had unearthed unaccounted cash of Rs 8.14 crores and unaccounted jewellery worth Rs.1.69 crores based on credible information.   The Department also seized documents which prima facie depict withdrawals of large amounts of cash from the state treasury by such contractors and engineers. No person holding any political office such as that of MLA, MLC or Minister, was searched in the aforesaid proceedings, the letter states. “On 27.03.2019, as is forthcoming from electronic media, Shri. H.D. Kumaraswamy, the incumbent Chief Minister, stated that the Department was intending to conduct search proceedings on politicians belonging to the ruling coalition,” the letter stated. “That such statements were made by a person who was unconnected with the search proceedings itself demonstrates the malafide intent that is, to scuttle the Department's processes,” it further stated. 60-year-old man accused of raping, impregnating minor girl in Karnataka

Over a period of four months, the man, a former BJP gram panchayat member, allegedly raped the girl multiple times.
A man has been accused of raping a 14-year-old girl over a period of four months and impregnating her in Karnataka’s Ballari district.  According to the complaint filed by the girl’s mother on Tuesday at the Hospet Rural Police Station, 60-year-old Chandrashekar had allegedly told the girl he would pay her to do household chores. The teen girl worked at a tea stall, and every day after school she would go there to work, according to the complaint. Chandrashekar allegedly began frequenting the tea stall a year ago. He allegedly paid the teen amounts varying from Rs 25 to Rs 50 and asked her to run errands for him. Chandrashekar is a former BJP gram panchayat member. “He would allegedly tell her that she could go to him and ask him for help if she ever needed and gained her trust. After a few months, he would give her small amounts of money and ask her to buy sweets or whatever she wanted to. We are very poor and so my daughter took the money from him,” the complaint notes. About four months ago, Chandrashekar allegedly asked the girl to help him out with some chores at his residence. When the minor girl arrived, Chandrashekar allegedly pulled her into his house and locked the door. “He told her that no one was at home. He forced himself on her and raped her. He then gave her Rs 50 and told her that if she spoke about the incident, he would kill her and all her family members,” the complaint reads. Chandrashekar allegedly raped the girl multiple times over a period of four months and each time, he would allegedly offer her Rs 50 and ask her not to speak to anyone about the incident. The mother grew concerned after the girl’s menstrual cycle stopped, according to the complaint. On April 8, the teen was taken to a gynecologist and it was found that she was pregnant. “My daughter was scared to tell us and finally she told us what Chandrashekar had done,” the complaint adds. An FIR was registered against Chandrashekar under sections 376 (rape) and 506 (criminal intimidation) of the IPC and under sections 4 (punishment for penetrative sexual assault) and 6 (punishment for aggravated penetrative sexual assault) of the POCSO Act. Chandrashekar is currently at large and the Hospet Rural Police are looking out for him.

SC Collegium recommends Justice AS Oka as new Chief Justice of Karnataka High Court

Justice AS Oka is currently the senior-most judge in the Bombay High Court.
The Supreme Court Collegium on Tuesday recommended the name of senior Bombay High Court judge Justice Abhay Shreeniwas Oka to be the new Chief Justice of Karnataka High Court.   In an official resolution dated April 8, the three most senior judges of Supreme Court which constitute the Collegium, Chief Justice Ranjan Gogoi, and Justices SA Bobde and NV Ramana, said, “Mr Justice AS Oka is the senior-most judge from Bombay High Court and is functioning in that High Court since his elevation. Having regard to all relevant factors, the Collegium finds Mr Justice AS Oka suitable in all respects for being appointed as Chief Justice of the Karnataka High Court. The Collegium resolves to recommend accordingly." It added, “While making the above recommendation the Collegium is conscious of the fact that consequent upon the proposed appointment, there will be two Chief Justices from Bombay High Court which is the second largest High Court in the country with a sanctioned strength of 94 Judges.” The appointment of a new Chief Justice was necessitated as Justice Dinesh Maheshwari, the erstwhile Chief Justice of the Karnataka High Court, was elevated as a Supreme Court judge in January. Currently, Justice Lingappa Narayana Swamy is the Acting Chief Justice of the Karnataka HC since January 17 following a Union Law Ministry notification stating the same. Along with Karnataka, the new Chief Justices of Rajasthan, Kerala, Meghalaya, Andhra Pradesh and Chhattisgarh HCs were recommended. A Live Law profile on Justice Oka states, “A glance of some judgments authored by Justice Oka undoubtedly reveals that he is a judge with a liberal outlook, who gives weightage to civil liberties over powers of the state.” He has given many landmark judgements including those revolving around noise pollution, the rights of atheists and the right to give “no religion” as an option in government application forms, a judgement striking down the beef ban in Maharashtra and encouraging prison reforms, among others. According to the Bombay HC’s official website, born on May 25, 1960, Justice Oka started practising as an advocate in Thane district court in June, 1983 after completing his BSc, LLM from University of Bombay. He later joined the chamber of VP Tipnis, a former Judge of the Bombay High Court and former Lokayukta. He was elevated as Additional Judge of the Bombay High Court in August 2003 and later as a permanent Judge in November 2005.

Riyanna, who finally received her voter ID card on Tuesday, will be one among several members of the transgender community who will be voting for the first time.
As the entire nation gears up for the Lok Sabha Elections, 22-year-old Riyanna from Bengaluru is all smiles as she is set to cast her vote for the very first time. “I have been applying for a voter ID card for the past three years. After having my application rejected 11 times, I have finally got it now,” she says. Riyanna, who finally received her voter ID card on Tuesday, will be one among several members of the transgender community in India who will be voting in a major election for the first time. Riyanna says she applied for the voter ID when she turned 18 but was rejected 11 times until she finally got it recently. “Getting the voter ID itself was so difficult for me because my application was rejected because of confusion. Despite being a citizen in the country, it was so difficult for me to get the ID because I am a member of the transgender community. But that is all the more reason that it is important for more people from the community to vote,” says Riyanna. The 22-year-old resident of Bengaluru will be voting from the Bengaluru Central on polling day. As she recounts the stress of obtaining a voter ID card, she emphasizes how crucial it is that everyone votes. “Something as simple as applying for a voter card becomes so difficult and complicated when you are from the transgender community. After having my application rejected so many times, I finally approached the Shantinagar MLA and told him about the difficulty I was facing in obtaining the voter ID. It was with his help that I was ultimately able to get my voter card,” she says, adding that this is why she feels it is important to have government representatives who are sensitive to the problems faced by transgender people. There are three major issues Riyanna feels need to be addressed for the betterment of transgender people in society: shelter, education and medical insurance. “I am one of the lucky ones, I get to stay at home with my family and I have a job. But what about the people who have been kicked out of their homes and have no place to go or no one to support them? It is crucial that the government helps to provide shelter for trans persons who require it,” she says. Riyanna also stresses that equal education opportunities be provided by the government to members of the transgender community, which she feels is how they will also be able to contribute to the betterment of society. “Not just that, but we also face a lot of difficulty when seeking healthcare. The government should take the responsibility of ensuring that all transgender people are covered with medical insurance.”

T-shirt logo helps Bengaluru police arrest 3 accused of murder

Bengaluru city police arrested 3 individuals, accused of murdering a 46-year-old daily wage labourer, by identifying a distinct logo which one of the culprits had on the t-shirt he was wearing. The three accused, identified as Lokesh (21), Sevaraj (19) and Sunil (20) reportedly saw the victim, Sathyasheelan, carrying two sachets of whiskey. When attempting to steal the sachets away from him, they stabbed him in the back with a knife, after the victim put up a fight. Sathyasheelan fell down near a roadside garbage dump and died. The incident took place on March 25 in Bengaluru’s Cox Town neighbourhood. Following the incident, Pulikeshinagar police were alerted by residents in the area who initially assumed the victim was drunk and passed out on the road. While police initially suspected that the man had died after a fatal fall, post mortem reports revealed a stab injury on his chest. This led cops to probe the incident further. “The autopsy report from Bowring and Lady Curzon Hospital said Satyasheelan died due to shock and haemorrhage as a result of the stab injury on the back of his chest. A case of suspicious death was registered and we formed a team led by inspector Firoz Mohammed. They cracked the case and arrested the accused,” said DCP (east) Rahulkumar Shahapurwad to TOI. One of the accused was wearing a white t-shirt with an ‘L’ printed on it. This was visible in the CCTV footage which the cops were looking through and using this clue, they were able to track down the culprits. According to reports, police officials were able to locate the accused, who were hiding in a graveyard, after gathering necessary basic information from the CCTV footage. When police tracked down the accused, they confessed to the crime. The knife used to commit the crime was also retrieved. The accused have been arrested and remanded to judicial custody.

Kodagu forest officials rescue 5 elephants stuck overnight in water reservoir

The incident comes less than a week after an elephant was shot dead by unknown assailants in the same area.
In a rescue operation which lasted nearly four hours, forest officials in Kodagu district rescued five elephants stuck in a water reservoir in Palangala village in Virajpet taluk of the district. The herd of elephants was spotted on Tuesday night as they were passing through a coffee plantation near Palangala. "We presume the herd arrived at the pond in search of water. However, in the process they must have fallen into the water," Regional Forest Officer (RFO) Gopal said. According to the RFO, the reservoir was dug up by farmers during the summer to water the coffee plantation. "Due to darkness, the herd must have fallen into the pond," he added. Forest officials reached the spot at around 8 am on Wednesday morning after being alerted by Mittu Aiyappa, a coffee grower in Palangala. However, the operation was delayed due to the late arrival of the earthmover machine. While one group of rescue officials carved a way out of the pond using an excavator machine, another group burst crackers to scare the animal in the direction of the forest area. "Eventually, around 11.30am we were able to rescue all the mammals from the water body, " RFO said.  According to officials, shortage of rain in the region and scarcity of grazing forest area has increased the human-animal conflict especially in Palangala. Over the last few years, forest officials have attempted to dig trenches, set up solar and iron fences, spike pillars, among the solutions to resolve the human-animal conflict in Kodagu. However, the issue continues to persist. Over the years, forest officials have attempted digging elephant trenches, setting up solar fencing, iron fencing, spike pillars among other solutions to resolve this problem. While locals along with officials have recently rescued about nine elephants in the last month from water reservoirs, one elephant was shot-dead by unidentified assailants. The elephant was shot dead last Thursday in the same village by unidentified assailants and forest officials are investigating the case. 7 rallies in 10 days: K’taka BJP believes PM Modi’s campaign will give final boost

In the 2018 Assembly polls, Prime Minister Narendra Modi’s campaigning was credited as the catalyst in improving the BJP’s tally in Karnataka from 40 to 104.
A year ago, in the run-up to the Karnataka Assembly Elections, the BJP, in a late switch, decided to increase the number of rallies addressed by Prime Minister Modi from 15 to 21. PM Modi's blitzkrieg run of addresses across the state was attended by lakhs of residents and was seen as the catalyst for the BJP improving its tally from 40 seats to 104 in the Karnataka Assembly. Ultimately though, it was not enough to help the BJP form the government in the state. A year later in the run-up to the Lok Sabha elections, the saffron party is looking to repeat the trick and hope that their fortunes in the state improve. On Monday, two rallies addressed by Modi in different parts of the state - in Mysuru and Chitradurga - drew large crowds with thousands chanting ‘Modi, Modi’ as he spoke on stage. This was a carbon copy of what was witnessed in the last phase of campaigning ahead of the 2018 Karnataka Assembly Elections. "This has been the case since the rally held in Benegaluru's Palace Grounds in November 2013. Modi has become a household name and a big factor in Karnataka since then," Malavika Avinash, a BJP spokesperson said. The rallies held in Chitradurga and Mysuru were the first two of seven public rallies Modi is scheduled to address in the state in ten days. The Prime Minister is scheduled to address rallies in Koppal on April 12, Mangaluru and Bengaluru on April 13. With Koppal, the BJP hopes to reach Raichur, Ballari and Haveri. This will be followed by two more rallies in northern Karnataka in Bagalkot and Chikkodi on April 18.  Through these rallies, the BJP plans to target the Hyderabad-Karnataka and Mumbai-Karnataka regions, with the party hoping the Prime Minister’s presence in Bagalkot will have a ripple effect in areas such as Bijapur, and Hubli, while the Chikkodi campaign will cover Belgaum and Chikkodi.   The last two rallies coincide with the first phase of voting in the state's southern districts. He also addressed two rallies - in Hubballi on February 6 and in Gulbarga on March 10 - before the elections were announced.  Political observers in the state also believe that Modi's ground presence is crucial for the BJP in Karnataka.  “In places, where Modi addresses rallies, there is a high possibility of 3-5% additional swing in favour of the BJP. Because even during the Assembly Elections, the BJP according to multiple estimates was touted to win 90 seats. But in the last few days, the rallies he addressed changed the BJP’s fortunes. The party ended up winning 104 seats, and there were at least 10 more seats the BJP missed by a whisker,” Mahadev Prakash, a political analyst explained. In the run-up to the State Assembly Elections, the presence of Modi was credited as the catalyst in improving the BJP's tally in the state from 40 to 104. Modi extensively campaigned in the state addressing 21 rallies which was 6 more than the 15 BJP had initially planned for the Prime Minister.  Speaking at the rally in Chitradurga, Modi claimed that every vote for the BJP was a vote for him to serve the people again over the next five years. "When you go to the polling booth and press the lotus button to vote for the BJP that vote will be for me and make me stronger to work for the country," Modi said. His statement comes at a time several BJP MP candidates in the state are building their election campaign on the achievements of the Modi-led central government. "We are proudly admitting that this election campaign is based on Modi and the larger interest of the country. The issues being highlighted are national security, reducing corruption and development of the country. We take a lot of pride in telling what Modi has done in five years in various rallies," Malavika added.  The same was reiterated by Dakshina Kannada BJP candidate Nalin Kumar Kateel. "We are trying to take forward Narendra Modi’s development of India for the last five years and there is a need to protect the country at this time," he said speaking to TNM. He is among 15 MPs from the party seeking re-election from Karnataka. The 'Modi effect' is a campaign motto echoed by BJP leaders across the state who are hopeful that the feat performed by the PM in 2018 is repeated in the Lok Sabha Elections and that the BJP is able to secure more than 20 of the 28 seats in the state. The venues of the rallies have also been decided to ensure that Modi has maximum outreach with voters in the state. It remains to be seen whether the presence of Modi will play a crucial role in convincing voters in the state in the face of the coalition's campaign to wrest a higher number of seats this year.

Khushbu was campaigning for the Congress-JD(S) candidate Rizwan Arshad in Bengaluru’s Indiranagar area on Wednesday, when the incident occurred. From the video, it can be seen that a huge crowd had gathered for an election campaign in Bengaluru. Khushbu can be seen walking alongside Shantinagar MLA NA Haris and Bengaluru Central candidate Rizwan Arshad towards her car. Suddenly, Khushbu can be seen turning around and slapping a man who is standing behind her. We do not know who the man is but I have asked the police to take action against him,” he added. However, Indiranagar Police told TNM that no FIR has been registered in the case and the youth was warned and let go. “We have not received any complaint yet. The police deployed for security warned the man and let him go,” the Indiranagar Police said. Khushbu joined the Indian National Congress on November 26, 2014. A prominent face in the party, she has been its National Spokesperson since March 24, 2015. Prior to this, she was with the DMK. She is one of the star campaigners for the Congress in the Bengaluru Central segment, which has a considerable population of Tamil-speaking people.

A man from Karnataka’s Belagavi district has been convicted by the district sessions court for forcing his wife to perform sexual acts with a puppy. On Tuesday, Justice VB Sooryavanshi held the man guilty of forcing his wife into having 'unnatural sex' and sentenced him to 10 years in prison. He was also fined with Rs 11,500. On March 25, 2017, the Katkol Police in Belagavi had received a complaint from a woman, who had been forced to leave home along with her three children due to severe physical and psychological abuse by her husband. She was 25 years old when she filed the complaint.  According to the police, Kavita* was married to Preetham* nine years ago. For five years, Preetham and Kavita did not have any problems in their marital life. The couple also have three children. However, in December 2016, Preetham began assaulting Kavita regularly when she refused to give in to his sexual demands. “He would make her watch porn videos on his phone and force her to perform sexual acts that were in the videos. In March 2017, he got his uncle’s puppy, which was about six to seven months old, and forced his wife to perform sexual acts with it,” says sub-inspector Vittal, the investigating officer in the case. Upon investigation, the police found that Preetham had made Kavita perform sexual acts with his uncle’s dog thrice within a span of two weeks. “When the woman repeatedly refused to comply with his demands, he would threaten to throw her out of the house and also abandon their children. The woman is a homemaker and she depended on him financially. He would also beat her up if she refused to do as he says,” SI Vittal added. The Katkol Police had arrested Preetham on March 25 and he was remanded to judicial custody. Preetham had petitioned the sessions court for bail. However, the bail was rejected. “He even petitioned the High Court but the court did not grant him bail and he was in jail until the trial got over. Now he has been convicted,” Vittal added. Katkol Police say that Kavita’s parents and Preetham's uncle, whose dog was used to perform sexual acts, testified on behalf of Kavita in court. “Apart from the survivor's testimony and the testimonies of her parents and her husband's uncle, we had solid evidence. We had got medical reports for the woman and the dog, which worked in favour of the survivor. The judge called it a heinous crime and has sentenced him to 10 years in prison,” Vittal added. *Names changed to protect identity of survivor.

Cong’s Rizwan Arshad alleges vendetta after I-T raids on campaign office, aides

Although the I-T Department is yet to issue an official statement, sources have confirmed to TNM that three businessmen connected to Rizwan were searched.
It seems there is no end to the parleys of charge and countercharge between the Income Tax Department and the ruling coalition in Karnataka. On Thursday, I-T raids were conducted on the campaign office and other locations in Bengaluru connected to Rizwan Arshad, the Congress-JD(S) candidate for the Bengaluru Central constituency. Most of the offices and buildings raided belong to businessmen close to him. The candidate has called it an ‘act of vendetta’ against him. “The I-T raids that have been conducted at my campaign office and on some of my associates are harassment tactics that the BJP is using to try to cripple my campaign. I see these raids as a vendetta by the ruling party at the Centre. They have consistently been engaging in orchestrating I-T raids on several Congress leaders and opposition leaders, not only in Karnataka but also across the country,” he said. “It shows that they are nervous and foresee defeat, which is why they are stooping to such low levels. It is a reflection of extreme insecurity of the BJP leadership. The Congress party will not be intimidated by such actions of the opposition. The people will give them a fitting reply as they are smart enough to see through their game plan,” he added. Although the I-T Department is yet to issue an official statement, sources have confirmed that the three persons who were raided are Kamal Pasha, Amanullah Khan and Naeez Khan. Thursday’s development comes a day after Principal Chief Commissioner of Income Tax in Karnataka asked Chief Electoral Officer, Sanjeev Kumar, to pursue criminal proceedings against Chief Minister HD Kumaraswamy and others, including ministers and political leaders The Chief Minister and his cabinet colleagues on March 28 in an unprecedented move had held a demonstration against the I-T in front of their Queens Road office in Bengaluru over alleged politically motivated raids. Other than the CM himself, others who participated in the protest were former CM Siddaramaiah, Water Resources Minister DK Shivakumar, Deputy CM G Parameshwara and Tourism Minister SR Mahesh. According to the I-T Department, searches on contractors and engineers involved in government contracts in the districts of Hassan, Mandya and Mysuru had unearthed unaccounted cash of Rs 8.14 crores and unaccounted jewellery worth Rs.1.69 crores.   They also clarified no person holding an office of an MLA, MLC or Minister, was searched. The letter stated, “When persons occupying high public offices, including constitutional posts, make false statements and voluntary instigate, and involve themselves in, such criminal activities with the sole purpose of adversely affecting the processes of the law and preventing government officials from discharging their duties, such activities and statements criminally intimidate and harm the personnel of the Department with greater intensity.”
