Gauri Lankesh murder: Accused Naveen Kumar's judicial custody extended till June 25

The Third Additional Chief Metropolitan Magistrate (ACCM) court in Bengaluru has extended the judicial custody of KT Naveen Kumar, one of the accused in the Gauri Lankesh murder case, till June 25. Naveen Kumar is currently lodged at the Parappana Agrahara central prison in Bengaluru. Naveen Kumar was charged on May 30 by the Special Investigation Team (SIT) with IPC section 302 (punishment for murder) and listed as the chief suspect in the Gauri Lankesh murder investigation.  According to the SIT charge sheet, he has been accused of providing logistical help to the out-of-state killers, and also watching Gauri Lankesh's movements before her killing.  The 37-year-old Naveen Kumar had refused to undergo a lie-detector test in April, citing ill health. He was supposed to undergo the narco-analysis test at the Forensic Science Laboratory (FSL) in Ahmedabad on April 16, but after being taken to the lab, he refused, citing that he had been coerced by the police into signing documents indicating his voluntary participation. He had even threatened suicide. Naveen Kumar was arrested by the Upparpet Police on February 18 this year in Bengaluru, and they recovered an illegal firearm and fifteen .32 calibre bullets from him.  He is the founding member of the Hindu Yuva Sene - a right wing Hindu organisation in Maddur, Mandya district, and also has links with Sanatan Sanstha, another right wing organisation that was on the police radar after Gauri Lankesh's murder.  Naveen Kumar, along with another accused Praveen, were charged with Sections 118 (concealing design to commit offence), 114 (criminal abetment)  120B (criminal conspiracy), 35 (criminal intent) of the Indian Penal Code in the 650-page preliminary charge sheet filed by the SIT.  Gauri Lankesh was murdered on September 5 last year at her Rajarajeshwari Nagar home by unknown assailants.   Read: Lingayat and Veerashaiva groups to unite? For months now, residents of the locality in CV Raman Nagar had been complaining about garbage and sewage accumulating on the lake.
Two days after he was allocated the portfolio of Bengaluru Development, Karnataka Deputy CM announced the setting up of a 5 MLD Sewage Treatment Plant (STP) at Kaggadasapura Lake, to prevent further damage to the lake’s ecosystem.  Parameshwara was accompanied by Bengaluru Mayor R Sampath Raj and other officials from BBMP and BWSSB. He later went to inspect the condition of Bellandur Lake. The Deputy Chief Minister said that officials have been directed to identify a suitable place for installing an STP at Kaggadasapura lake and also to ensure that similar STPs were installed in other major lakes.  For months now, residents of the locality in CV Raman Nagar had been complaining about lapses on the part of civic agencies in preventing garbage and sewage from ending up on the lake.  Instead of desilting and cleaning the lake, the locals accused the local MLA and corporator of building a temple, a garden and a 30-feet-wide walking ramp along the lake. “Today, the Minister and the Mayor had come because of the constant effort of the apolitical groups over the past one year to save the lake. Even two weeks before today, the Mayor had visited the lake and understood the problems and we explained what exactly is needed for the lake's rejuvenation,” Mohan Dasari, who is part of Save Kaggadasapura Lake, said.  Mohan has also contested the local assembly polls as an AAP candidate. Locals want the lake to be taken under the BBMP’s lake rejuvenation programme which has been a success. Currently, both the BDA and BBMP claim the lake to be in each other’s custodianship. Speaking about the alleged illegal construction work by the local BJP MLA S Raghu, Mohan said, “Normally, the pathways will be of 10 feet but in some places, there is a 60 feet pathway without any proper tendering process. We have filed RTIs with both the BBMP and BDA and they have said that they are not doing these works.” In the last six months, these works have stopped due to pressure from apolitical groups, he said.  “As an immediate step, there is a need to build STPs in two-three locations. There is one inlet of sewage from Pai Layout and another inlet from Bagmane Tech Park. Other than the sewage, locals allege BBMP Solid Waste Management contractors dump garbage including plastic in the lake bed. 27 Bengaluru establishments shut down for playing live music without licence

Twenty-seven establishments in Bengaluru have been forced to down their shutters for allowing live music to be played on their premises without a licence, according to the Print.  This, however, isn’t new. This crackdown came after a 2005 Karnataka High Court order was upheld by the Supreme Court in January this year. The Licensing and Controlling of Places of Public Entertainment (Bangalore City) Order of 2005 mandated restaurants to obtain a licence for live music performances. These 27 establishments have been booked under Section 294 of the IPC and notices have been issued to several others.  Speaking to the Print, Bengaluru Commissioner T Suneel Kumar said that music — recorded or live — at any place would be public entertainment.  “All of them will have to apply for licences with us… It is important to understand that these regulations have been put for the safety and security of people,” the Commissioner told the Print.  Why is it coming into effect after 13 years? In 2005, the Karnataka Live Band Restaurants Association filed a plea against the Licensing and Controlling of Places of Public Entertainment (Bangalore City) Order of 2005, on the grounds that it violated Article 14 and Article 19(1)(g) of the Constitution — equality and the right to practice any profession or occupation. In January this year, a Supreme Court Division Bench comprising Justices RK Agrawal and Abhay Manohar Sapre upheld the 2005 order, and said that since these performances are carried out in restaurants where the public have access and, therefore, in the larger public interest, "these performances have to be controlled, regulated and supervised.” The apex court said that the order of 2005 was issued in view of the safety and morality of the people at large, and it "does not suffer from any legal infirmity and is therefore constitutional"."Indeed, the order of 2005 has been issued only with a view to control, regulate and supervise these performances in restaurants. Since these performances are displayed in a restaurant where public has an access and, therefore, in the larger public interest, these performances have to be controlled, regulated and supervised by imposing reasonable restrictions in law under Clause (6) of Article 19(1)," it added. When the Supreme Court upheld the 2005 order in January, commissioner T Suneel Kumar said: “Based on the safety and other conditions as per the order, if these are satisfied, then a licence will be issued. Thanos has landed in the Bengaluru and Mysuru railway stations – except he’s teal in colour instead of purple, and has decided that half the plastic waste in the world must go. Also, he’s not called Thanos, but Biocrux Pet Bottle Flaking Machine, and has been installed at multiple railway stations by the South Western Railway, in order to reduce plastic pollution in the premises. The machine takes in empty water bottles – of upto 2 litre capacity – and disintegrates them into plastic flakes, which are then treated and used for producing other items, like bins and even T-shirts. Watch: In fact, people who feed their bottles into the machine will be rewarded for curbing plastic pollution – for every bottle in Bengaluru stations, an user is credited Rs 5 on their PayTM account. The machines have a provision of entering the mobile number of the user, once a bottle is put in the slot. The automatic, noiseless crusher costs a little over Rs 3 lakh, and have been installed in a bid to keep the station clean. Officials of the South Western Railways say that, although the station is relatively clean, often discarded water bottles end up in the tracks and floors of the platform. “Other than keeping the station clean, this will also prevent this single use plastic bottles from being reused, or other harmful practice,” an official told TNM. “Often there are vendors who collect all these disposed bottles and sell them in the market for reuse.” Officials said that since the machines were installed in January, there has been visible improvement in the amount of plastic waste found in the stations – although much more needed to be done. “The machine usually takes up 1,000 plastic bottles per day while the average footfall in the station is close to 60,000,” the officer added. Currently, they’ve installed the crushers in Platform 1 of Mysuru. Similar machines have been installed in Bengaluru’s KSR City Station, Yeshwantpur Station, Cantonment Station and Krishnarajapuram Stations on the occasion of World Environment Day (June 8). Soon, similar machines will be installed in other five platforms of Mysuru and other major stations of the division like Shivamogga and Davanagere. The machines were also installed in other railway divisions across the country including Ahmedabad, Pune and Mumbai. The Railways are also trying to use this as a channel of revenue by forming agreements with plastic manufacturers. There are also talks of engaging Corporate Social Responsibility funds to install more of these machines.

Teachers say K’taka Min’s plan to merge single-teacher schools will affect students

Newly appointed Primary and Secondary Education Minister N Mahesh's proposal to merge government schools in the state which are administered by single-teachers has not gone down well with teachers and academicians. Mahesh held a review meeting of the Education Department on Monday, and following this, he revealed his intention to integrate as many as 3,450 single teacher schools in the state. “There are several schools with single teachers and very few students. In such cases, students of all classes sit in one classroom.This will cost the department both academically and financially. Merging does not mean closing down. Shifting the infrastructure to another school would be a good idea,” he said, as per The New Indian Express. , Mahesh is the lone MLA from the Bahujan Samaj Party (BSP) in the state and was elected from Kollegal constituency. The move, if implemented, will mostly affect the functioning of lower primary schools. There are 3,372 lower primary government schools and a further 78 higher primary schools that are run by a single teacher in Karnataka. The schools are also mostly located in remote, rural areas of the state according to academicians. Even though the minister assured no schools will be shut and that they will only be ‘merged’, academicians and activists point out that merging of the schools can only happen when many of them are shut down. Teachers working in single-teacher schools in the state explain that merging the schools will cause problems for students who have to travel away from their village for education.  Ravi, who runs a single-teacher school in Channapatna in Ramanagara district, says, “There are two students in the school right now, and the nearest government school is 2 km away, that is if you cut across the fields in the village.” “The roads are not in good condition and it will be difficult for the students to go on their own. Since the residents of the village are mostly involved in agriculture, it would be difficult for them to take their children to school and bring them back,” he explains. Teachers and academicians also point out that the proposal flies in the face of a report drafted by the Kannada Development Authority (KDA) to strengthen government schools in 2017. "The report was compiled after conversations with teachers, students, and parents, mostly from villages, and many shared interesting insights saying that closing a school in a village is akin to closing off a cultural institution," says VP Niranjan Aradhya, fellow at the Centre for Child and Law, National Law School of India University, Bengaluru, who was also part of the committee that drafted the report. The report published in 2017 made 21 recommendations to improve education in the state – the first of which stated that closure of schools needs to be stopped and that all schools closed in the previous year need to be reopened. The state government however says that the merging will help improve the quality of education in these schools. “We are aware that many of the schools mentioned in the proposal are in remote, rural areas and our priority is to ensure no student is affected. The discussion that was held yesterday was regarding improving the quality of the education in the schools,” said BK Basavaraj, Director of Public Instruction Department. Officials at the Education Department, who took part in the meeting with N Mahesh on Monday, said that the new proposal to merge single-teacher schools was yet to be discussed by the members of the department. “The minister has given the statement about the proposal but we have not discussed the pros and cons of this yet. In yesterday’s meeting, he gave the details of the proposal to our department members and we are going through it now. We are going to decide what will be done and how we can do it,” said Philomina Lobo, Director of Public Instruction, Secondary Education. “Our priority remains that students are not inconvenienced,” she added.  

Adding Tulu to official languages list: Udupi MLA promises to take issue up in Assembly

The long-drawn demand for the inclusion of Tulu in the Eighth Schedule of the Indian Constitution saw fresh support from the BJP’s Raghupathi Bhat, newly elected MLA of Udupi. In response to a Twitter user’s allegation that he was ignoring the language, Bhat said that he was proud of his Tulunadu credentials, and that he would try his best to include Tulu in the Eighth Schedule of the Constitution – which lists the languages recognised as official languages of the country. In his tweet, the Udupi MLA also made use of the hashtag ‘#TuluTo8thSchedule’, one that was the subject of an online Twitter campaign by activists in August 2017.  Although Bhat may steer a renowned political push for the language in the next Assembly Session, the ball is now in the court of the Centre, according to Tuluva activists. Speaking to The News Minute, Chandrahas Rai, registrar at the Karnataka Tulu Sahitya Academy, said that a memorandum had already been submitted to the Prime Minister’s Office in 2016. “The central government now has to decide the matter of inclusion. Our proposal went before the Home Minister and the Prime Minister. We expect that they will do something in the future,” he said, adding that future plans of the Academy include hosting a meeting of Members of Parliament from Karnataka to support the issue when it comes up in the Lok Sabha. Even as campaigns for inclusion are spearheaded by Tulu organisations, social, cultural and academic roots of the language remain strong in the coastal region of Karnataka. Art-forms and plays conducted in Tulu, such as Yakshagana, still resonate with much of the population in Udupi and Mangaluru. Tulu cinema has seen increased viewership not just from the region, but even in states such as Mumbai and several Middle-Eastern countries as well. Academic developments over the past few years have been aimed at familiarising the new generation with the language. With the help of the Karnataka Tulu Sahitya Academy, several colleges and high schools in the district offer Tulu as a language. On May 18 this year, a committee at the Mangalore University decided to expedite syllabus formation processes to include Tulu as an optional subject in post-graduation and graduation courses from the upcoming academic year. The 2016 launch of the Tulu Wikipedia, India’s 23rd regional Wikipedia, added more focus on the scholarly contributions to the language’s promotion. The website was even reported to have received mention in the pro-inclusion memorandum submitted to Prime Minister Modi by Tuluva activists later that year. Ultimately, despite assurances from the Central Government, it remains to be seen if the language will make its much demanded appearance in the Eighth Schedule of the Constitution. At present, the Eighth Schedule has 22 languages, with the Ministry of Home Affairs claiming demands for inclusion of 41 more languages.

Officials order closure of 10 companies near Bannerghatta after illegal mining exposed

Following the exposure of rampant illegal mining and destruction of the elephant corridor at Bengaluru’s Bannerghatta Biological Park, the state government has finally issued closure notices to 10 more mining companies. The Mines and Geology Department began cracking down on these irregularities occuring in Thammanaikanahalli, located in the Eco Sensitive Zone, and issued notices to 10 companies on Monday, asking them to shut down by Tuesday evening. These companies are even being slapped with penalties up to Rs 80 crores. According to the Ministry of Environment, Forests, and Climate Change, no mining activity can be allowed within the 10 kilometre boundary of a national park, tiger reserve, or wildlife sanctuary. However, these companies had been carrying out mining activities within the 10 km radius of the Eco Sensitive Zone (ESZ). Earlier in April, the Department of Mines and Geology had issued closure notices to five other companies located in Shivanahalli, though the department has not yet determined the penalties to be levied on the companies, said Prasanna Kumar, Director of Mines and Geology Department. In May, after environmental activists raised the issue of illegal mining being carried out in Thammanaikanahalli, the department commissioned a Joint Survey Report separately for the violations at both Shivanahalli and Thammanaikanahalli. The Joint Survey and spot inspection was done by the Mines and Geology Department, the Survey Department and Forest Departments. The surveys aimed to check three major aspects - to check whether the companies had indulged in excessive mining within the ESZ, to determine the amount of minerals plundered, and the environmental violations. Blatant violation of norms According to the Joint Survey Report conducted for violations in Thammanaikanahalli, the 10 companies had not maintained boundary stones and was quarrying stones with the ESZ. Further, the companies had not adhered to the norms of the limit of stones which could be mined. “There is only a certain amount of stones which can be mined. The limit which was set was 1 lakh tonnes however, they have plundered 20 lakh tonnes. They have violated the cut volume norms also,” Prasanna Kumar added. Kumar says that the companies’ activities have also resulted in increased levels of air pollution. “The Karnataka State Pollution Control Board has set certain norms which cannot be violated by those involved in mining activities. For instance, these companies have not paid heed to the amount of dust generated while mining. They have also not taken any safety measures to prevent health problems caused by polluting surrounding water bodies. They have been asked to shut down by the end of the day,” he added. Creation of roads in Elephant corridor According to a senior officer with the Forest Department, the inspection for the joint survey revealed that roads were built in the Elephant corridor and garbage was also being dumped within the ESZ. Expressing satisfaction with the outcome of the survey, Vijay Nishanth, urban conservationist said, "Our reiteration that the mining companies have thrown all norms to the dustbin has been vindicated. The offenders need to be prosecuted for quarrying indiscriminately for so many years now. They have not only destroyed the elephant corridor but have also not taken any mitigation measures to safeguard the health of the people in the 47 villages." The Forest Department stated in May that mining activity was taking place outside the 10 km radius of Bannerghatta Biological Park and that no such violations were taking place in the Eco Sensitive Zone.    “This is an extremely good move on behalf of the Department of Mines and Geology. However, what is of concern is the amount of time it will take to restore the damage done,” added Vijay Nishanth. Speaking to TNM, Dr TV Ramachandra of the Indian Institute of Science, who had submitted the report on the ecological damage caused by these companies, said that the mining activities had caused severe fragmentation in the animal habitat in the park. “The ESZ is demarcated because these are biologically and hydrologically sensitive zones. It is not just mining activity that we found on spot inspection but also that a BDA-approved housing layout is coming up on Bukka Sagara area, which is located in the ESZ. With mining on one side and house on the other, it creates bottlenecks for animals. They can’t move around in their natural habitat and results in man-animal conflict. This zone is for animals alone,” Dr Ramachandra added.  

Gauri Lankesh murder: SIT nabs man suspected to be the shooter

On Tuesday afternoon, the SIT produced 26-year-old Parashuram Waghmore in a Bengaluru court. He has been remanded to 14-day police custody.
Who killed Gauri Lankesh? This is the question that has haunted thousands after her cold-blooded murder in September last year. Now, the Special Investigation Team probing her murder have arrested a man named Parashuram Waghmore (26), who they believe is the man who shot her. On Tuesday afternoon, the SIT produced 26-year-old Parashuram Waghmore in the 3rd ACMM Court in Bengaluru, where investigators alleged that he was the shooter who killed Gauri Lankesh. He has been remanded to 14-day police custody. Two days ago, the SIT arrested Parashuram Waghmore from Sindgi in Vijayapura district. Another man named Sunil Aksar, who was questioned, reportedly gave clues to the SIT about Parashuram’s whereabouts. SIT says that Sunil had no role in the murder. “The sketches drawn up by the SIT and also his pictures match. He was detained for two days, and after questioning him, we were sure that he was Gauri Lankesh’s shooter. We have not yet found the murder weapon but we know that one of the six people arrested has the weapon,” an SIT source told TNM. The SIT, which had reconstructed the crime scene, had sent the CCTV footage and also the video of the reconstruction to the forensic lab. Based on the analysis, the forensic report had stated that a man who is not more than 5.1 ft weighing 60-70 kg killed Gauri Lankesh. “Also, when Sujeet Kumar alias Praveen was detained, we realised that Parashuram Waghmore and Manohar Edave had practised shooting for a couple of months before the murder. Parashuram conducted the recce of Gauri’s house more than once,” the SIT source said. One of the investigators said that Parashuram had moved to Bengaluru from Sindgi two months before Gauri’s murder and was also working in a shop close to her house. “Parashuram is believed to have worked at one of his relative’s shop located near Gauri Lankesh’s house. We are being careful at this stage because it is very crucial to locate the murder weapon. The accused may also try to mislead us and we are being cautious. Initially when we questioned Manohar Edave, one of the accused, he misled us. But when we detained Parashuram we did not tell Manohar about it and that’s when we confirmed that he was misleading us,” the source added. SIT sources say that Parashuram was one of the accused booked in a case where pro-Hindutva activists had burnt the flag of Pakistan outside the Tahsildar’s office in Sindgi in 2012. “He was affiliated to the Hindu Janajagruti Samiti and previously, the Shri Rama Sene as well. We have also found that Parashuram was given the gun a day before Gauri Lankesh’s murder,” the SIT source added. Gauri Lankesh was shot dead outside her home in Bengaluru’s Rajarajeshwarinagar on the night of September 5, 2017. After months of investigations, the SIT arrested a man named KT Naveen Kumar in January this year. His arrest had revealed a larger plot where the killers were allegedly targeting other rationalists in the state. After Naveen’s arrest, the SIT also arrested Sujeet Kumar alias Praveen, Amol Kale, Amit Degwekar and Manohar Edave in May. The SIT had taken them into custody and realised that none of them was the shooter. Finally, on Sunday, the police arrested Parashuram Waghmore, who they believe is the shooter.

Thanks to K’taka HC, Bengaluru may not get another unwanted ‘expert committee’

The court on Monday directed the state govt to transfer all documents in connection with the Bengaluru Blueprint Action Group to the Bengaluru Metropolitan Planning Committee.
In a joy for civic activists, the Karnataka High Court has effectively put off the formation of yet another “expert committee” for the betterment of Bengaluru. This comes just days after CM Kumaraswamy met Infosys co-founder Narayana Murthy for forming such a committee under the new government. The Karnataka High Court on Monday directed the state government to transfer all documents in connection with the Bengaluru Blueprint Action Group (BBAG) to the Bengaluru Metropolitan Planning Committee (BMPC). This, after the state government told the court that in a June 8 notification, the current HD Kumaraswamy-led dispensation had terminated the BBAG. A day before the notification, the state government was criticised by the High Court for setting up such an “expert” group. "Let the statutory bodies work. Creating parallel body is undesirable, unwarranted and absolutely uncalled for, as such bodies will only add to confusion," the division bench comprising Chief Justice Dinesh Maheshwari and Justice Krishna S Dixit had observed on June 7, while hearing a plea filed by Namma Bengaluru Foundation and Citizens Action Forum. The BBPAG, an “expert committee” formed by then-CM Siddaramaiah for the betterment of Bengaluru in 2016 with quasi-executive powers, had industry heads like Kiran Mazumdar Shaw and Azim Premji as its members, along with elected representatives. K’taka HC calls expert panels formed by state for B’luru’s development ‘undesirable’ Expert committees, like Agenda for Bangalore's Infrastructure and Development formed by then CM Yeddyurappa, usually headed by non-subject matter experts, are not something new. A new committee has been constituted with every new government the state has seen since SM Krishna's tenure, with none of the committees having much success to show for. Citizen groups have vociferously stood against these “expert, elitist and non-inclusive” committees, on account of them being a committee parallel to the constitutionally mandated Metropolitan Planning Committee (MPC). They are of the opinion that through these expert committees, the government of the day can bypass the mandated norms, like the formation of ward committees and consulting the public for every big cost-intensive project as per the Country and Town Planning Act. Moreover, there were allegations of the committee members who are usually not from urban planning and relevant fields, backing unscientific projects without any public consultation.

A 74% cut in the User Development Fee (UDF) for both domestic and international flights at the Kempegowda International Airport (KIA) in Bengaluru, has been proposed by the Airports Economic Regulatory Authority (AERA) of India.  The new consultation paper put by the AERA recommends the UDF to be reduced to Rs. 316.8 and Rs. 79.2 for international and domestic flights respectively.  Currently, the KIA is among the highest charging airports in the country, where international bound travellers have to pay a UDF of Rs. 1,226, while domestic travellers pay Rs. 306.  When contacted by TNM, a Bangalore International Airport Limited (BIAL) spokesperson said, “This is a consultation paper put out by AERA. All stakeholders will now submit their views on paper, based on which AERA will issue a final tariff order.” The last day for all stakeholders - including BIAL, various airlines and government agencies - to respond, has been set as June 25, 2018. If they all come to an agreement, the new UDF is set to be implemented from July 1 this year, bringing relief to many passengers. The AERA also recommends reduction in parking and landing charges at the KIA. It also recommends an increase in the UDF from April 2019 till March 2020 to Rs. 373 and Rs. 93 for international and domestic flights. A further increase of Rs. 416 and Rs. 104 for April 2020 to March 2021 is proposed. Earlier this year in February, the AERA had stepped in and cancelled the proposed hike in UDF for construction of the KIA-Nagavara metro line. The AERA had ruled out collection of a flat UDF from all passengers stating that the BIAL was not authorised to collect the UDF on services that are not yet provided.  The new KIA-Nagavara metro line is set to be ready in Phase II of the Bengaluru Metro in 2020, and connects the Kempegowda International Airport to the city in an elevated line stretching 29.6 km.   Read: Thanks to K’taka HC, Bengaluru may not get another unwanted ‘expert committee

A day after Bhavesh Jaiswal, a 23-year-old Mu Sigma employee in Bengaluru allegedly committed suicide, police have booked his employer for alleged abetment of suicide. This after the victim’s father, Mahendra told police that his son had complained of workplace harassment, and was apprehensive of getting sacked. Although Bhavesh, a trainee decision scientist at the data analytics company, wanted to resign from the position himself before getting terminated, his employment clause meant that he had to shell out money for breaching the contract. This was an accusation made by Mahendra in his complaint, TNM could not independently verify this information. Bhavesh according to his contract had secured employment for three years as a trainee decision scientist at the analytics firm a year ago, and had resumed work on Monday after a long leave, police said. Police are currently in the process of collecting evidence and forensic officials are going through his computer and mobile phone for clues. Till Wednesday morning, police had not recovered any suicide note and are exploring his call records. DCP Whitefield, Abdul Ahad told TNM, “So far we have given the laptop and phone for forensic examination. The extract will take some time. We are expecting a report within a week, then we can come to a conclusion (without any suicide note).” Meanwhile, the police are interrogating officials from Mu Sigma and others but mostly relying on forensic evidence, the senior officer added.   Shivanna, a sub inspector at Whitefield Police Station confirmed that the police have taken up a case against Mu Sigma under section 306 (of the Indian Penal Code after a complaint was made by the family. “The family told police that management was harassing Bhavesh and that ultimately resulted in him taking the extreme step,” the police officer said. Bhavesh, a native of Madhya Pradesh and who was staying in Indira Nagar along with his mother and sister was reported dead little after 4pm on Monday at ITPL,a major tech park in Whitefield. Mu Sigma could not be reached for a statement on the development. The company, in a statement, made on Tuesday, had said, “We are deeply saddened and shocked by the passing away of one of our employees. He had joined Mu Sigma in the latter part of 2017. We have informed his family, and they are understandably in a state of shock. It is too early to share further information at this stage. Congress surged to a victory in the election to Jayanagar Assembly constituency on Wednesday with candidate Sowmya Reddy winning by a margin of a little over 2,000 votes against BJP's BN Prahlad. Elections were held on Monday in the constituency after it was countermanded earlier due to the death of BJP candidate BN Vijayakumar just days before the May 12 State Assembly Elections.  Sowmya Reddy, the daughter of senior Congress leader and former Home Minister Ramalinga Reddy, is the Congress candidate making her electoral debut. BJP, meanwhile, fielded BN Prahlad, brother of popular leader BN Vijayakumar in the constituency.  However, the BJP's plan appears to have backfired after Congress candidate Sowmya Reddy's chances were boosted after JD(S) candidate Kalegowda pulled out from the race in support of Soumya. The Congress and the JD(S) formed a coalition government in the state after the elections threw up a fractured mandate.  Sowmya's win means she is the only woman MLA to be elected in Bengaluru alongside 27 men who won earlier. She was also previously in the news for hosting a ‘zero-waste’ wedding and considers herself a staunch vegan, animal rights activist and environmentalist.  The win means the Congress-JD(S) combine has a total of 119 seats in comparison to BJP's 104 in the 224-seat Assembly. The BJP has failed to make further inroads into the Congress-JD(S) combine after succumbing to a loss in the polls to Rajarajeshwari Nagar on May 31. Congress candidate Muniratna emerged victorious in the seat winning 1,08,064 votes and increasing his party’s tally to 79 MLAs. Polls to Rajarajeshwari Nagar was countermanded ahead of the May 12 election owing to largescale seizure of voter ID from an apartment in the area. A bye-election will now be held in Ramanagara constituency after Chief Minister HD Kumaraswamy won in two constituencies - Ramanagara and Channapatna. Anita Kumaraswamy, wife of HD Kumaraswamy, who earlier contested from the constituency in 2013 is being considered as the candidate for the Congress-JD(S) combine.

Nine-months after the brutal murder of journalist Gauri Lankesh in Bengaluru, the Special Investigation team, in a major breakthrough, arrested Parashuram Waghmore (26), who is suspected to be the shooter. SIT sources had earlier revealed that Parashuram Waghmore was affiliated to the pro-Hindutva outfit, Shri Rama Sene. Now, a picture of Parashuram, with the Sene’s chief Pramod Muthalik is being circulated on social media. The photograph was reportedly taken a few years before. Speaking to TNM, Pramod Muthalik blatantly refuted allegations that he knewParashuram Waghmore and has even denied that the accused was a part of the Shri Rama Sene. “No, I don’t know him. Thousands of people click photos with me. Where ever I go, they click pictures. When I am walking on the road, people will come and click pictures with me. When I go to a hotel, they click pictures with me, in my house also they come and click pictures. So based on these photos, one cannot say that he is our (Shri Rama Sene’s) activist,” Muthalik said. When asked whether he remembered Parashuram or when the photograph was taken, Muthalik said he could not recall such an instance at all. “No, I don’t remember. Let it be. What can I do if the photo is being circulated? Can I stop it?” he said. However, the chief of the pro-Hindutva outfit, who was acquitted in the Mangaluru pub attack case of 2009 for lack of witnesses, claimed that the police had, in the past as well tortured pro-Hindutva activists during questioning. “He is an accused now. Let there be an inquiry. In the past also the police has arrested several pro-Hindutva activists and tortured them during questioning. Let them prove it in court first and if he is found guilty then he must be punished. Until then, we cannot say anything,” Muthalik told the media in Mangaluru. When TNM asked him about the suspected motive behind Gauri Lankesh’s murder, Pramod Muthalik condemned the act. “Its not right, its wrong. What they did was wrong. If Parashuram is found guilty, then he must be punished,” Muthalik added. 

‘Man-made catastrophe’: NGT Commission submits scathing report on Bellandur Lake

The Commission set up by the National Green Tribunal to determine the extent of damage in Bellandur and Varthur lakes in Bengaluru has submitted a scathing and explosive report. The Commission, in its report severely objurgated authorities’ in-charge of Bellandur lake and said, “Apparently, the biggest lake of the beautiful city of Bengaluru by sheer callousness and indifference of the authorities has become the largest septic tank of the city.” The Commission noted that the Bellandur Lake has “rapidly shrunk” due to “indiscriminate dumping of construction and demolition waste, municipal solid waste and due to vast spread of hydrophyte and microphytes in the lake water”. Shrunken lake area and encroachment According to an analysis by the Karnataka State Remote Sensing Applications Centre, the lake area was 906 acres 25 guntas in 1973, which has now been reduced to 322.85 acres. “An approximate area of 2 acres and 25.08 guntas has been encroached by DRDO under the category of Government Encroachment. We have also been apprised that an approximate area of 4 acres and 02.08 guntas is under private encroachment,” the report adds. Reduced water storage capacity As per the Commission, the water storage capacity of the lake in 1973 was 18.67 ml cubic meters and the capacity currently stands at a mere 5.50ml cubic meters. The remaining 13.16ml cubic meters of storage capacity now consists of 6.60 ml sediment deposits and 6.56 ml cubic meters of slush deposits. The ultra-utility of the lake, and its storage capacity has diminished by 71.45%, says a report by the Indian Institute of Science. “The factors namely sediments, slush deposits and hydrophytes, which led to this man-created catastrophe has been subsequently enumerated extensively in the report,” the Commission stated. The infamous fire According to the report, the Bellandur Lake has caught fire 12 times since the first incident on August 12, 2016. According to a report submitted by the Fire Department and the Karnataka State Remote Sensing Applications Centre to the Commission, 53.16 acre of Bellandur Lake has suffered burn due to fire. “The Central Pollution Control Board (CPCB) has submitted that high oil and grease values in Bellandur Lake amounting to 24.27mg/l, is because it has been accumulating over the years. This oil and grease, when sticks to hyacinth and dried grass results in becoming conducive material for fire and smoke,” the report adds. The Commission also concluded that the spontaneous combustion of the accumulated methane is not the cause for the fire as the area has never witnessed the required increase in temperature for methane to combust (537 degrees Fahrenheit). The Commission is of the opinion that the fire was a result of an accidental spark or that it was deliberately set off. Cleaning up of water hyacinth (hydrophates) The Commission noted that 60% of the 366 hectares of lake area was covered with water hyacinth and that the pace of de-weeding was so slow that the hyacinth would grow back in no time. “After looking at the pace of de-weeding process that was going on, the Commission was of the unequivocal view that the de-weeding could never be completed in near future. The reason for the same is not only slow pace of the work with only four de-weeding machines at site functioning at the time of inspection,” the report states Also, huge mounds of de-weeded hyacinth had been dumped along with domestic waste material like plastic on the site itself and that the de-weeded hyacinth was not being converted to compost in a scientific manner. Up on inquiry, the Commission found that no organisation or government agency is willing to accept the de-weeded, mound of garbage, which is being passed off as compost and dumped on the site of the lake. “15-20 feet deep pits are made in the lake bed within the boundary of the lake. The said compost along with its solid waste is dumped into the pit and then covered with excavated earth. Shockingly, the excavated earth for creation of pits for composting was to a large extent nothing but construction and demolition waste,” the report states. “There cannot be a greater farce than the alleged removal of hyacinth and disposal of the so-called compost on which lakhs and lakhs of precious public money is being diverted,” it adds. Municipal and solid waste The report states that approximately 22,000 cubic metres of construction and demolition debris has been dumped in the past. In addition, substantial amount of Municipal Solid Waste had been piled up at the outlet points of the Rajakaluve into Bellandur Lake. The report states the presence of 6.56 million cubic metres (MCM) of slush deposit, 6.606 MCM of sediment deposit and 1700 Kg per cubic metre of bulk density sediments were present in the lake. Sewage entering the lake There are totally 17 inlets into Bellandur Lake. Of these only two of them carry treated water into the lake and five of them carry sewage. The remaining 10 are dry during the non-monsoon period. “The paramount reasons for pollution of Bellandur/Varthur Lake are sewage flowing in the storm water drains entering the lake, rapid and large-scale urbanization, change in land use pattern, under capacity of sewers, encroachment of sewers, damages to sewerage system and direct discharges from apartments, new layouts etc., leading to substantial quantity of sewage flowing in the storm water drains,” the report states. According to the report, the sewage from the Koramangala SWD amounts to 83 MLD, 80 MLD from the Agara SWD, 11 MLD from the HAL SWD, 5.6 MLD from the Iblur SWD and 3.4 MLD from the Kempapura SWD. “The Commission however observed that unfortunately the directions by this Hon'be Tribunal to correct the mischief have not been complied with in letter and spirit since the untreated effluent and sewage indiscriminately continues to pollute the lakes,” the report adds.

From an RJ to a lead actor: Meet Kajal, a trans woman from K'taka breaking new ground

In Indian film industries, even when transgender women are portrayed on screen, the role is played by a cis man. Kajal's foray into movies will change that.
Over the last few years, Kajal has tried her hand at a variety of jobs, and has been harbouring many a dream. Two years ago, she planned to open a beauty parlour. A year later, she wanted to be a radio jockey and this year, she decided she wanted to act. While the beauty parlour never panned out, Kajal, a trans woman became the first transgender person in coastal Karnataka to become a radio jockey in November 2017 when she went on the air for the first time on Radio Sarang, 107.8, a community radio channel run by St. Aloysius College (Autonomous) in Mangaluru. Earlier this week, she ticked one more box in her personal bucket list after being cast as the lead in a film. She will be appearing as the protagonist in Mysuru-based director Chandan Gowda's film, Love Baba.  Kajal says that her journey has been long, arduous and yet interesting at the same time. "It has kept me on my toes," she admits. She was born in Mandya and now resides in Brahmavar in Udupi district.  She credits a professor at Mahatma Gandhi Memorial (MGM) College in Udupi for inspiring her to work towards her dreams. "Manjunath sir asked me to share my story in colleges and this improved my public speaking skills. He always encouraged me to study and work towards what  I wanted to do," she says. Through Manjunath, Kajal met Avinash Kamath, the Editor-in-Chief of Udupi-based Spandana TV who gave Kajal her first exposure to the workings of a media house. Around this time, Kajal was invited to speak at various forums on issues that the transgender community faces, and in one such event, Abhishek Shetty from Radio Sarang in Mangaluru, got in touch with her. "He asked me if I wanted to be a radio jockey and I could not believe it for a moment," exclaims Kajal.  On November 21 2017, Kajal's voice rang out on air for the first time as she anchored 'Shubhamangala', a show that raises issues related to the transgender community.  Soon after, in another feather on her cap, she was cast in a role in 'ICU Noduve Ninna', a play by HP Raviraj at the Rangabhoomi theatre in Udupi. "Raviraj Sir gave me a role in the play and this gave me exposure to acting, and soon enough, a film director came calling," she says.  She is now set to break new ground once again by becoming the first transgender person to act in a leading role in a film. "I have dreamt of acting in a film since I was a child but I never thought it was possible," she says.  Kajal also believes that the film will prove that transgender persons can take up leading roles in films, something that is lacking in films made in India. "Many times, transgender persons are portrayed as outcasts or in a comedic role. How often is it that you see a transgender person in a leading role in the film? In this film, the character I am playing is that of a woman but the difference is just that it is played by a trans woman," she says defiantly.  The shooting of the film will see Kajal crisscross in Karnataka to locations including Sakleshpur, Mysuru, Mangaluru and Udupi.

For the first time in Karnataka, a father-daughter duo will be legislators in the state Assembly at the same time. While Sowmya Reddy won the polls from Jayanagar in Bengaluru for the Congress, her father is Congress heavyweight Ramalinga Reddy, currently MLA of neighbouring BTM Layout. He has served as a minister many times and was Home Minister is the Siddaramaiah government. The Congress despite facing stiff criticism for its ‘dynastic politics’ had gone ahead and given tickets for the Assembly polls to sons (Sowmya being the only daughter in that list) of prominent leaders of the party. Father-son duos are quite common in the assembly and the Congress has two prominent father-son duo this time— Siddaramaiah and his son Yathindra and Shamanur Shivashankarappa and his son SS Mallikarjun.    Noted political commentator, Mahadev Prakash said that the only other occasion when a daughter of a prominent politician in Karnataka made the cut was when Chandraprabha Urs, became an MLA and minister in 1983. But this was after the death of her father and former CM Devaraj Urs. The Jayanagar seat was incidentally held by Ramalinga Reddy, before delimitation. Following delimitation, Ramalinga Reddy shifted to BTM layout. The BJP held the Jayanagar seat since then, thanks to BN Vijaya Kumar.     While, rest of the state went to polls on May 12,  polling in Jayanagar constituency was deferred after BN Vijaya Kumar, who was seeking re-election, passed away onMay 4 (after the date of notification). Elections were postponed in RR Nagar seat too, following large scale seizures of Voter ID cards from an apartment in the constituency. In both these elections following the formation of coalition government, Congress emerged victorious limiting BJP’s tally to 104 seats in the state Assembly. Commenting on the victory, Ramalinga Reddy said, “There was a responsibility to win. There were others who were aspiring for ticket. In Jayanagar, I am still familiar with people. After our government came to power, we did much developmental work and the constituency had benefited. I thank CM Kumaraswamy, Rahul Gandhi and other leaders of the state. A victory is a victory regardless of the margin.   He said that he had won from the same seat from 1979 for the first time and his daughter had seen his work. He added, “She had a desire to help people and being a legislator she can work in that direction.”    At the end of counting, Sowmya defeated BJP’s BN Prahalad, brother of sitting Jayanagar MLA with a slender margin of 2889 votes. In Jayanagar, what might have worked in Congress’ favour despite the sympathy wave for the BJP is the withdrawal of JD(S) from the electoral fray. After the results were announced, a triumphant Sowmya said, “This is just not my victory. It is the victory of each and every person who has put an effort to make this happen. It is for Congress party workers, leaders, of course my family and my father, Mr Ramalinga Reddy’s victory. I have to thank the party High Command for actually believing in me giving me a ticket,” the MLA-elect told reporters.  

Kalu Ram’s lynching over child abduction: B’luru police clueless, form probe team

A 26-year-old man was lynched to death in the heart of Bengaluru by residents of Chamarajpet in May this year, only because they believed he was a child abductor. These residents, just like many in Andhra, Telangana and Tamil Nadu had become anxious after reading WhatsApp messages about child abductors on the prowl. The Bengaluru police, which is investigating the death of 26-year-old Kalu Ram is now sending a fact-finding team to Rajasthan, which they believe is Kalu Ram’s home state. The fact-finding team is set to gather more evidence and also record statements of the relatives of Kalu Ram. Kalu Ram was brutally lynched by a mob in Bengaluru on May 23. Fourteen people were arrested by the Chamrajpet police and booked for murder, including two minor boys. “I’m currently assembling a team to send to Rajasthan to gather more information about the deceased, and also take statements of his relatives. When this information is gathered, we will be filing the charge sheet in a few more days,” Ravi D Channannavar, DCP West, told TNM. However, the Bengaluru police are still clueless about where these WhatsApp messages originated from. Soon after Kalu Ram’s death and the outrage surrounding the fake WhatsApp messages, the Bengaluru Police Commissioner, T Suneel Kumar, had announced that the investigators have also enlisted the help of the Cyber Crime unit to trace the source of these messages. When TNM caught up with Additional DCP of the Cyber Crime unit, Jinendra Khanagavi, he said he knew nothing about such an investigation. “I don’t know anything about it. Only DCP West Ravi Channannavar knows about this case,” he added. Several such spurious WhatsApp forwards have been making the rounds among residents of the city, warning them about alleged child kidnappers. The Bengaluru police have issued several warnings asking the public not to fall for such forwards. They have also asked the public not to take the law into their own hands but rather inform and work with the police. The Bengaluru police have also said that criminal action will be taken against people who spread inflammatory messages. Spate of incidents in Tamil Nadu, Andhra Pradesh and Telangana Mobs outraged by fake WhatsApp forwards chased a family of five in Tamil Nadu’s Thiruvannamali district in early May this year, and they killed one woman in the group. An intellectually disabled man was attacked and hung by a mob in Palaverkadu in Tamil Nadu on May 9. In neighbouring Telangana, Nimmala Balakrishna was killed on May 22 in Ziapalli, on the suspicion of being a child abductor, while two tribal youths were beaten in Nizamabad district on the same suspicion. One of them, Devya Naik succumbed to his injuries, while Degavath Laalu is said to be in critical condition in Nizam’s Institute of Medical Sciences in Hyderabad. The Special Investigation Team probing the cold-blooded murder of noted journalist-activist Gauri Lankesh last September, is likely to seek permission for brain mapping and lie detector tests for four accused. A source in the SIT told TNM that narco tests will be sought as the accused are reportedly not co-operating with the investigation.  Parashuram Waghmore (the alleged shooter), Amol Kale (mastermind), Amit Degwekar and Manohar Edave are among the accused arrested in the case, and the SIT wants them to be ‘brain mapped’. The SIT claims that with the arrest of Parashuram on Sunday, they have made significant headway into solving the murder, which happened nine months ago. The next step for the investigation is to recover the murder weapon. It has also come to light that they had plotted to kill KS Bhagwan three months back. SIT probes Till now, the SIT claims that it has been misled by multiple accused arrested in the case but it has managed to unravel a larger plot to kill other rationalists and authors like KS Bhagwan and Girish Karnad. Notably, it has also been claimed by the SIT that forensic reports suggest that the same murder weapon was used for murdering noted rationalist MM Kalburgi in Dharwad. Gauri Lankesh was shot dead from point blank range at her doorstep in Bengaluru’s Rajarajeshwarinagar on the night of September 5, 2017.  Earlier, the SIT had got permission from the 3rd ACMM Court to undertake narco analysis of KT Naveen Kumar, the first accused to be arrested in the case. However, he had refused to undergo the test once he was taken to the Gujarat Forensic Science Lab in Ahmedabad. This has been recorded in the first charge sheet submitted to the court.  Other than this, the roughly 650-page preliminary chargesheet had included 131 witnesses, including forensic experts and eyewitnesses. It also included statements of family members of Gauri Lankesh, doctors who performed the autopsy and the officers who visited the spot on the night of the murder. After Naveen’s arrest, the SIT had subsequently arrested Praveen, Amol Kale, Amit Degwekar and Manohar Edave in May. The investigators claimed that they have searched several places in Karnataka, Goa and Maharashtra after the arrest of Praveen and his three aides.  The source claims that clinching evidence has been obtained in the case so far.

After 115 days, Mohammed Nalapad granted conditional bail by Karnataka HC

He has been in jail for more than a 100 days for assaulting 24-year old Vidvat in a fit of rage.
After many twist and turns, Mohammed Nalapad, the son of Congress MLA NA Haris, has been granted conditional bail by the Karnataka High Court in an assault case. The conditions are that he cannot step out of the state without the permission of the court. He has also been asked to submit his passport. He has to furnish a bond of Rs 2 lakh and two sureties, said TV reports. He has been in jail for 115 days. The bail  comes more than three months after he was taken into custody by the police for allegedly assaulting 24-year old Vidvat in a fit of rage.  This is the third bail plea in the case after the first two were rejected on March 14 by the 8th ACMM Court and on May 30 by the Bengaluru City and Civil Court. Nalapad was arrested on February 19, two days after he and his associates allegedly assaulted Vidvat, the son of a prominent businessman, in an uptown café in Bengaluru, over an altercation The chargesheet filed by the Central Crime Branch (CCB) revealed that Nalapad initiated the incident and provoked his aides with the intention of murdering Vidvat. According to the chargesheet submitted to the court, containing 23 witness statements, the CCB confirmed that the clash between the two was triggered when Nalapad’s leg touched Vidvat’s right leg, which was covered with plaster of paris, for he was recovering from an accident. “I am a son of local MLA NA Haris. You are not even equal to my shoe. You say sorry and kiss my feet,” Nalapad is reported to have said before hitting him with glass bottles, ice buckets and other items. Soon after, Nalapad had reportedly said, “If you don’t say ‘sorry’, then I will kill you here only.” Charges against Nalapad include attempt to murder (section 307 of the Indian Penal Code), a section which was added two days following his arrest. The initial FIR against Nalapad was registered under sections 341 (wrongful restraint), 506 (criminal intimidation), 143 and 144 (unlawful assembly), 146 and 147 (rioting), 326 (voluntarily causing grievous hurt by dangerous weapons) and 504 (intentional insult with intent to provoke breach of peace) of the IPC. The Special Public Prosecutor Shyam Sundar appearing for Vidvat time and again had argued that the injuries inflicted on Vidvat were not only grievous but also not limited to a single place. At the Karnataka High Court, he had submitted  three videos as evidence, which reportedly showed Nalapad entering UB City along with 15 men.    In his statement too, Vidvat revealed to the police that he was assaulted on three separate occasions in UB City - in Farzi Cafe, in the escalator and in the parking lot - by Nalapad and his men. The case became politically contentious too, given the timing of the incident. Nalapad Haris is the son of Congress MLA NA Haris. BJP and AAP supporters hit the streets in protest, embarrassing the Congress, in the wake of the incident. Nalapad was sacked from the position of Bengaluru Youth Congress President and the party. Incidentally, NA Haris was not named in the first list of 218 candidates for the Assembly elections. However, it did not appear to deter Haris in his bid to get re-elected as he comfortably won once again from Shantinagar constituency. In Tuesday's hearing, tempers flared between the defendant and the prosecutor at the mention of NA Haris's name. The defendant was adamant that NA Haris's name should not be besmirched due to the incident. However, Shyam Sundar responded by asking why NA Haris had posted the discharge summary of Vidvat on Facebook and questioned whether Haris was using his influence as an MLA to tamper with the investigation.  

Rains continue to lash Kodagu, boats pressed into service to rescue stranded

One person has lost his life due to the rains. On the Kodagu-Kerala border, there has been no power or water supply for five days.
By S Mubarak Unrelenting rains continue to lash Kodagu, bringing the district to a standstill due to landslides and fallen trees. There has been no vehicular movement as trees have fallen in at least 25 places. On Wednesday night, many vehicles were waiting for the landslide to be cleared on the Iritty (Kannur) - Makutta (Kodagu) State Highway were washed away due as the Makutta river overflowed. Although authorities were successful in alerting and convincing many people to abandon their vehicles and evacuate from the area by foot, one truck helper lost his life. His body has been retrieved. Authorities have expressed concern over the flowing of Lakshmana Tirtha River and other rivulets, and have pressed in the services of boats to rescue stranded people. Napoklu, Bhagamandala, Virajpet Kasaba, Hudkeri, Srimangala, Shantalli, Nittoor, Ponnampet are among the areas that have received maximum rainfall. At Bhagamandala, the residents were ferried by authorities on boats. The residents of at least 180 houses in low-lying areas at Karadigodu in Siddapura (Virajpet) have been notified by the Kodagu district administration to vacate on a priority basis since the water levels of the Cauvery river have been increasing.  On the Kodagu-Kerala border, there has been no power or water supply in the region for over five days due to the torrential rains. The district administration has announced a holiday for all schools and colleges. As compared to last years’ monsoon, the rainfall in the district has nearly doubled. Between January 2017 and June 2017, 406.66mm of rainfall was recorded. During the same period this year, 847.01mm of rainfall was recorded until Tuesday. The Harangi Reservoir, whose capacity 2859 feet, has already been filled upto 2815.28ft as of June 12. The inflow of the water has increased by 7260 cusecs, as compared to 1352 cusecs last year. Hectares of farmlands primarily comprising of coffee and other commercial crops have reportedly been affected due to the continuous downpour. Several vehicles were also destroyed due to fallen trees. The Deputy Commissioner of Kodagu, Sreevidya, has banned vehicular movement under Section 115 of the Motor Vehicles Act 1988 and the Karnataka Motor Vehicle Rules 1989 (Amendment Code 1990) and as per Rule 221 A (5). Vehicular movement from Makutta to Perumbadi will be shut till July 12. "The travellers alternatively can use Gonikoppa-Ponnampet-Srimangala-Kutta road," the DC's order said. In the midst of rain for 12 days, authorities have also set up a ganji kendra (food centre) at a government school to provide meals and shelter for the needy. The police, fire personnel and CESCOM linemen are coordinating the distribution of kerosene oil and food parcels in areas to where people are stranded.
